AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD, CALIFORNIA, APPROVING A FORMAL
AGREEMENT RELATING TO A PUBLIC LEASEBACK BY
AND BETWEEN THE CITY OF BAKERSFIELD AND THE
CITY OF BAKERSFIELD PUBLIC FACILITIES COR-
PORATION.
THE CITY COUNCIL OF THE CITY OF BAKERSFIELD, CALIFORNIA,
DOES ORDAIN AS FOLLOWS:
SECTION 1.
The agreement by and between the City of Bakersfield and
the City of Bakersfield Public Facilities Corporation, which
agreement is a "public leaseback" as that term is defined by
Government Code Section 52450(b), is approved. Three copies of
said agreement, entitled "Amendment No. 1 Bakersfield Facilities
Site Lease and Project Lease (Wastewater Treatment Plant 3),"
hereinafter referred to as "Agreement," are on file with the City
Clerk of the City of Bakersfield.
SECTION 2.
The Mayor is hereby authorized to execute, and the City
Clerk to attest, said Agreement; provided, however, that the "base
rent" required by Section 3 of said Agreement does not exceed the
amount specified in Section 3 hereof.
SECTION 3.
The "base rent" required by Section 3 of said Agreement
shall not exceed $950,000 annually.
SECTION 4.
This ordinance shall be subject to referendum pursuant to
the provisions of the Election Code of the State of California, as
the same relate to referendum.
SECTION 5.
This ordinance shall be posted in accordance with the
City charter provisions and shall become effective thirty (30)
days from and after the date of its passage.

I HEREBY CERTIFY that the foregoing Ordinance was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on March 2, 1988 , by the
following vote:
