AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AMENDING SECTION 17.06.020 OF
CHAPTER 17.06 (ZONING MAP) OF THE
MUNICIPAL CODE OF THE CITY OF BAKERSFIELD
REGARDING PREZONING OF PROPERTY KNOWN AS
THE OSWELL NO. 7 ANNEXATION.
WHEREAS, in accordance with the procedure set forth in
the provisions of Title 17 of the Municipal Code of the City of
Bakersfield, the Planning Commission held a public hearing on a
request by the City of Bakersfield to zone certain property now
being annexed to said City and made several general and specific
findings of fact which warranted a negative declaration of
environmental impact; and
WHEREAS, there appears to be no substantial detrimental
environmental impact which could result from this zoning action;
and
WHEREAS, the proposed zoning substantially conforms to
~he General Plan; and
WHEREAS, the City Council has determined after due con-
sideration of the motion and recommendation of the Planning
Commission, herein on file, together with the reasons advanced at
the Planning Commission hearing, that said zoning should be
authorized upon annexation of said property to the City.
NOW, THEREFORE, BE IT ORDAINED by the Council of the
City of Bakersfield as follows:
A. All the foregoing recitals are found to be true and
correct.
B. The Negative Declaration for this zoning action is
hereby approved and adopted.
C. That Section 17.06.020 of Chapter 17.06 (Zoning Map)
of the Municipal Code of the City of Bakersfield, be and the same
is hereby amended by extending the boundaries of said map to
include that certain property in the County of Kern located east
of Oswell and south of Virginia Avenue, contiguous to the Oswell
No. 6 Annexation being contiguous to the boundary of the City of
Bakersfield, known as the OSWELL NO. 7 ANNEXATION, upon the
annexation of said property to the City of Bakersfield,
specifically described as follows:
TO AN R-1 (ONE FAMILY DWELLING) ZONE:
That portion of the Southwest ¼ of
Section 35, T.29S., R.28E., M.D.B. & M.
in the County of Kern, State of
California, more particularly described
as follows:
Beginning at a point of intersection of
the East line of the West 55 feet of
the Southeast ¼ of sai~ Section 35 and
the South line of the North ½ of the
Southeast ¼ of said Section, said point
being on the East line of Oswell Street
(Co. Rd. No. 2739);
THENCE Northerly along said East line,
639.35 feet more or less, to the South
right-of-way line of Alloway Lane (Co.
Rd. No. 1495);
THENCE North 89051'05" East along said
South right-of-way line of Alloway Lane
as shown on Tract 2172 filed April 14,
1959 per Map Book 10, Page 131 in the
Office of the Recorder of the County of
Kern 276.08 Feet to the Southeast corner
of the afore-mentioned Tract 2172;
THENCE North 0030'20" East along the
East line of said Tract, 30.002 feet to
the centerline of Alloway Lane, said
point also being the Southwest corner
of Virginia Avenue School Property;
THENCE Easterly along the South line of
the North ½ of the Northwest ¼ of the
Southwest ¼ of Section 35, said line also
being the South line of Virginia Avenue
School Property, 662.17 feet more or
less, to the Southeast corner of said
property;

THENCE Northerly along the East line of
said school property also being the
West line of the East ½ of the Northeast
¼ of the Northwest ¼ of the Southwest ~
of Section 35, a distance of 649.44 feet
more or less, to a point on the South
right-of-way line of Virginia Avenue (Co.
Rd. No. 1249), said point also being the
South line of the North 10 feet of the
Southwest ¼ of Section 35;
THENCE Easterly along said South line,
1634.74 feet more or less, to the West
line of the East 20 feet of the Southwest
¼ of Section 35;
THENCE Southerly along said West line,
said line also being the West right-of-
way line of Sterling Road (Co. Rd. No.
254), 1,308.94 feet more or less, to
the South line of the North ½ of the
Southwest ¼ of Section 35;
THENCE Westerly along said South line,
2573.62 feet more or less, to the Point
of Beginning.
CONTAINING 63.16 ACRES OF LAND (MORE OR
LESS).
Approval of the above zone change is made subject to the
following conditions:
Developer shall provide park acreage or in-lieu fees
according to the Park Plan requirement for dedication of
2.5 acres per 1,000 population.

Prior to recordation of the final Tract or Parcel Map,
the developer will be required to form, or to have the
property included in an existing park maintenance dis-
trict.
This ordinance shall be posted in accordance with the
City Charter provisions and shall become effective upon the
annexation of the above-described territory to the City of
Bakersfield, but not less than thirty (30) days from and after
the date of its passage.
