Exempt pursuant to Code 27383 The undersigned Grantor(s) declare(s) that the DOCUMENTARY TRANSFER TAX IS: $ 0 Grantee is Exempt Gov't Agency(R&T 11922) RESOLUTION NO. 018-2 0 2 0 A RESOLUTION OF THE COUNCIL TO VACATE THE 20' ALLEY RUNNING EAST AND WEST BETWEEN PINE STREET AND CEDAR STREET, NORTH OF BRUNDAGE LANE (WARD 2) o� gAKe'9Nri t m ORIGINAL RESOLUTION NO. 018-2 0 2 0 A RESOLUTION OF THE COUNCIL TO VACATE THE 20' ALLEY RUNNING EAST AND WEST BETWEEN PINE STREET AND CEDAR STREET, NORTH OF BRUNDAGE LANE (WARD 2) WHEREAS, on WEDNESDAY, JANUARY 22, 2020, the Council of the City of Bakersfield, pursuant to the provisions of the "Public Streets, Highways and Service Easements Vacation Law," Government Code Sections 8300 et seq. of the Streets and Highways Code of the State of California, declared its intention to vacate the 20' alley running east and west between Pine Street and Cedar Street, north of Brundage Lane (Ward 2); and WHEREAS, the Council did fix a time and place for hearing all persons interested in or objecting to said proposed vacation, which hearing was held on February 19, 2020, after notices of said hearing were duly published and posted as required by law; and WHEREAS, for the above-described project, it was determined that the proposed vacation is exempt from CEQA, pursuant to Section 15061 (b) (3) of CEQA Guidelines (General Rule) in that there is no possibility that the proposed action could have a significant effect on the environment; and WHEREAS, on December 5, 2019, Planning Department found the vacation to be consistent with the Metropolitan Bakersfield General Plan, per local ordinance. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: The above recitals are true and correct and are incorporated herein. 2. This Resolution is adopted pursuant to Section 8300, et seq. of the Streets and Highways Code of the State of California. 3. The Council orders the vacation of the 20' alley running east and west between Pine Street and Cedar Street, north of Brundage Lane, (more specifically described in Exhibit "A" and illustrated in Exhibit "B", which is attached hereto and incorporated herein), all in the City of Bakersfield, County of Kern, State of California. 4. The City is to reserve a Public Utility Easement (PUE) and access for City services over the vacated area of the 20' alley running east and west between Pine Street and Cedar Street, north of Brundage Lane. Per the Bakersfield Fire Department, a 20 foot fire access is still required to be maintained. If gates are installed, the minimum width for manual opening gates shall be 20 feet (6096 mm), and minimum vertical clearance of 13'6" is required when the gate is at full open position and with a Knox pad lock or box installed. Electric gates shall be equipped with a means of opening the gate by fire department personnel for emergency access. Emergency opening devices shall be approved by the fire code official. All new construction of access gates shall be equipped with an automatic opening device which is activated through the wireless activation system utilized on City of Bakersfield owned vehicles for traffic preemption. 6.
