A RESOLUTION OF THE BAKERSFIELD CITY COUNCIL
AUTHORIZING THE FINANCE DIRECTOR TO DISPENSE WITH
FORMAL BIDDING PROCEDURES AND MAKE FINDINGS IN
ACCORDANCE WITH CALIFORNIA GOVERNMENT CODE
SECTION 4217.12 ET SEQ. TO ENTER INTO AN ENERGY
SERVICE CONTRACT WITH TANKO STREETLIGHTING TO
PROVIDE TURNKEY SERVICES TO RETROFIT
APPROXIMATELY 2,938 DECORATIVE STREETLIGHT POLES
TO LIGHT EMITTING DIODE (LED), NOT TO EXCEED
$1,100,000
WHEREAS, Government Code section 4217.10, et seq., authorizes a public
agency to enter into an energy service contract without going through a formal
bid process if its governing body determines, at a regularly scheduled public
hearing, public notice of which is given at least two weeks in advance, that (1) it
is in the best interest of the City to enter into such energy service contract, and
(2) if the City finds that the anticipated cost to the City for the electrical energy
or conservation services provided by the energy conservation facility under the
contract will be less than the anticipated marginal cost to the City of electrical
energy that would have been consumed by the City in the absence of those
purchases; and
WHEREAS, the City of Bakersfield has 2,938 decorative streetlight poles with
high-pressure sodium fixtures that need to be retrofitted to LED technology; and
WHEREAS, Tanko Streetlighting, Inc. is a national firm that specializes in turn
key streetlight conversion to LED; and
WHEREAS, Tanko Streetlighting, Inc.'s pricing and costs provided to the City
are based on working extensively with City staff to audit the existing streetlights
and determine the best and most economical and energy efficient retrofit to LED
technology; and
WHEREAS, based on the energy cost analysis provided by Tanko
Streetlighting, Inc., attached to the proposed contract as Exhibit A, City staff
estimates an annual ongoing energy savings of $131,000 after all City decorative
streetlight poles are retrofitted to LED technology; and
WHEREAS, the breakdown of Tanko Streetlighting, Inc.'s cost to retrofit the
City's decorative light poles to LED technology is approximately $1,000,000 to

retrofit (approximately $328 per fixture) and $100,000 for contingency (replace
fixtures that cannot be retrofitted or broken lenses); and
WHEREAS, the Public Works Department recommends the Council authorize
the Finance Director to dispense with bidding for this energy
efficient/conservation project and approve the agreement with Tanko
Streetlighting, Inc. to retrofit the City's decorative streetlights that contain high-
pressure sodium fixtures with LED technology along the City's roadways; and
WHEREAS, the City Council finds and determines that it is in the best interest
of the City to enter into a contract with Tanko Streetlighting, Inc. for the proposed
improvements.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield
as follows:
1. The City Council finds and determines that the above recitals are true
and correct and incorporated herein by reference.
2. This resolution is adopted following a public hearing at a regularly
scheduled meeting of the City Council for which a minimum of two weeks public
notice has been duly given.
,3. The City Council finds that (1) it is in the best interest of the City to
enter into an energy service contract with Tanko Streetlighting, Inc. for the
implementation of certain energy related improvements to City facilities, and (2)
the anticipated cost to the City for electrical energy or conservation services
provided by the conservation facility under the contract will be less than the
anticipated marginal cost to the City of electrical energy that would have been
consumed by the City in absence of those purchases.
4. The Finance Director is authorized to dispense with bidding therefor
in accordance with Government Code section 4217.10, et seq., and authorizes
the City to enter into an energy service contract with the Tanko Streetlighting, Inc.
in an amount not to exceed $1,100,000.
