RESOLUTION NO.
RESOLUTION OF THE BAKERSFIELD CITY COUNCIL UPHOLDING THE
DECISION OF THE PLANNING COMMISSION AND DENYING THE APPEAL
TO AMENDMENT TO THE LAND USE MAP DESIGNATION OF THE
METROPOLITAN BAKERSFIELD GENERAL PLAN, LOCATED NEAR THE
NORTHEAST CORNER OF THE ASHE ROAD AND TAFT HIGHWAY
INTERSECTION (GPA/ZC NO. 19-0009).
WHEREAS, KFT Holdings for Phyllis Henry, filed an application with the City of Bakersfield
Development Services Department requesting an amendment to the land use map
designation of the Metropolitan Bakersfield General Plan from RR (Rural Residential) to GC
(General Commercial) on 3.75 acres and an amendment to Title 17 of the Bakersfield
Municipal Code to change the Zone District from A (Agriculture) to C-2/PCD (Regional
Commercial/Planned Commercial Development) on 3.75 acres, located near the northeast
corner of the Taft Highway/Ashe Road intersection (the "Project"); and
WHEREAS, the applicant and/or property owner has indicated the purpose of the
Project is for the development of up to 42,000 total square feet (sf) of regional commercial,
including a gas station/convenience store, a fast food restaurant with drive thru, and various
retail buildings at the Project site; and
WHEREAS, KFT Holdings, on behalf of Phyllis Henry, the property owner, filed an appeal
with the City Clerk on December 13, 2019 of the Planning Commission's recommendation to
deny the Project; and
WHEREAS, the Clerk of the City Council set Wednesday, February 19, 2020 at 5:15 p.m.
in the Council Chambers of City Hall, 1501 Truxtun Avenue, Bakersfield, California, as the time
and place for a public hearing before the City Council to consider the appeal as required by
Government Code Section 65355, and notice of the public hearing was given in the manner
provided in Title 17 of the Bakersfield Municipal Code; and
WHEREAS, during the hearing, the City Council considered all facts, testimony, and
evidence concerning the staff report and the Planning Commission's deliberation, and
action.
NOW, THEREFORE, BE IT RESOLVED by the Bakersfield City Council as follows:
1. The above recitals, incorporated herein, are true and correct.
2. The Council has considered and concurs with the findings made by the Planning
Commission set forth in Resolution No. 116-19 adopted on December 5, 2019.
3. The appeal is upheld and General Plan Amendment No. 19-0009 is denied.
