HomeMy WebLinkAboutRES NO 021-2020RESOLUTION NO. 02 1_ 2 0 2 0 A RESOLUTION OF THE BAKERSFIELD CITY COUNCIL DENYING THE APPEAL TO AMENDMENT TO TITLE 17 OF THE BAKERSFIELD MUNICIPAL CODE TO CHANGE THE ZONE DISTRICT, LOCATED NEAR THE NORTHEAST CORNER OF THE ASHE ROAD AND TAFT HIGHWAY INTERSECTION (GPA/ZC NO. 19-0009). WHEREAS, KFT Holdings for Phyllis Henry, filed an application with the City of Bakersfield Development Services Department requesting an amendment to the land use map designation of the Metropolitan Bakersfield General Plan from RR (Rural Residential) to GC (General Commercial) on 3.75 acres and an amendment to Title 17 of the Bakersfield Municipal Code to change the Zone District from A (Agriculture) to C-2/PCD (Regional Commercial/Planned Commercial Development) on 3.75 acres, located near the northeast corner of the Taft Highway/Ashe Road intersection (the "Project"); and WHEREAS, the Planning Commission held a public hearing on December 5, 2019, and approved Resolution No. 116-19, which recommended that the City Council deny the Project; and WHEREAS, KFT Holdings, on behalf of Phyllis Henry, the property owner, filed an appeal with the City Clerk on December 13, 2019 of the Planning Commission's recommendation to deny the Project; and WHEREAS, the City Council considered all facts, testimony, and evidence concerning the Project, including the staff report and the Planning Commission's deliberation, and action; and NOW, THEREFORE, BE IT RESOLVED by the Bakersfield City Council as follows: 1. The above recitals, incorporated herein, are true and correct. 2. The Council has considered and concurs with the findings made by the Planning Commission set forth in Resolution No. 117-19 adopted on December 5, 2019. 3.
