HomeMy WebLinkAboutORD NO 3150ORDINANCE NO. 3150 NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING SECTION 17.06.020 OF CHAPTER 17.06 (ZONING MAP) OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD REGARDING PREZONING OF PROPERTY KNOWN AS THE CALLOWAY NO. 1 ANNEXATION. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission held a public hearing on a request by the City of Bakersfield to zone certain property now being annexed to said City and made several general and specific findings of fact which warranted a negative declaration of environmental impact; and WHEREAS, there appears to be no substantial detrimental environmental impact which could result from this zoning action; and WHEREAS, the proposed zoning substantially conforms to the General Plan; and WHEREAS, the City Council has determined after due con- sideration of the motion and recommendation of the Planning Commission, herein on file, together with the reasons advanced at the Planning Commission hearing, that said zoning should be authorized upon annexation of said property to the City. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: A. All the foregoing recitals are found to be true and correct. B. The Negative Declaration for this zoning action is hereby approved and adopted. C. That Section 17.06.020 of Chapter 17.06 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by extending the boundaries of said map to include that certain property in the County of Kern located at the northeast corner of Rosedale Highway and Calloway Drive and contiguous to the boundary of the City of Bakersfield known as the CALLOWAY NO. 1 ANNEXATION, upon the annexation of said prop- erty to the City of Bakersfield, the boundaries of which property are shown on the map hereto attached and made a part of this ordinance, and are more specifically described as follows: TO AN R-1 (ONE FAMILY DWELLING) ZONE: A parcel of land situated in Southwest 1/4 of Section 20, T.29S., R.27E., M.D.B.&M., County of Kern, State of California, more particularly described as follows: Beginning at a point on the West line of the Southwest 1/4 of said Section 20, from whence the Southwest corner of said Section bears South 00029'05" East a dis- tance of 584.61 feet; Thence North 00029'05" East, 779.74 feet; Thence South 89°08'14" East, 690.77 feet; Thence South 00°29'05 West, 779.74 feet; Thence North 89°08'14" West, 690.77 feet to the POINT OF BEGINNING. EXCEPTING THEREFROM the Public Street right-of-way for Calloway Drive. CONTAINING 11.83 ACRES (MORE OR LESS) TO A C-2 (COMMERCIAL) ZONE: A parcel of land situated in the County of Kern, State of California, being a portion of the Southwest 1/4 Section 20, T.29S., R.27E., M.D.B.&M. more particularly described as follows: Beginning at the Southwest corner of said Section 20, said point also being the Centerline of Rosedale Highway (State Route VI-KER 58) and Calloway Drive (CO.RD.NO. 522); Thence North 00o29'05" East along West line of said Section 20, 584.61 feet; Thence South 89°08'14" East, 690.77 feet; - 2 - Thence South 00°29'05" West, 354.61; Thence South 89°08'14" East, 150.00 feet; Thence South 00029'05" West, 230.00 to a point on the South line of the Southwest 1/4 of said Section 20; feet Thence North 00029'05" East, 840.77 feet to the POINT OF BEGINNING; EXCEPTING THEREFROM the Public Street right-of-way for Rosedale Highway and Calloway Drive.
