HomeMy WebLinkAboutROI NO 867RESOLUTION OF INTENTION NO. 867 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD, CALIFORNIA, DECLARING ITS INTENTION TO ORDER THE VACATION OF A PORTION OF ELEVENTH STREET, A PORTION OF COTTONWOOD ROAD, AND A PORTION OF ROBINSON STREET, IN THE CITY OF BAKERSFIELD, STATE OF CALIFORNIA. The Council of the City of Bakersfield, California, pursuant to the provisions of the "Street Vacation Act of 1941" being Sections 8300, et.seq., of Division 9, Part 3 of the Streets and Highways Code of the State of California, does hereby resolve as follows: SECTION 1: That it is the intention of the Council of the City of Bakersfield to order the vacation of a portion of Eleventh Street in the City of Bakersfield, said portion being more particularly described as follows: Situated in the City of Bakersfield, County of Kem, State of California, being a portion of Section 32, Township 29 South, Range 28 East, M.D.S.& M., more particularly described as follows: All of Eleventh Street of 60.00 feet in width, between the east line of Robinson Street and the west line of Cottonwood Road, excepting and reserving the above-described vacation as a Public Utilities Easement, as said streets and road are shown on map of Tract No. 1301, filed May 28, 1946, in the office of the County Recorder of Kern County, California, in Book 5 of Maps, page 141. SECTION 2: That it is the intention of the Council of the City of Bakersfield to order the vacation of a portion of Cottonwood Road in the City of Bakersfield, said portion being more particularly described as follows: A portion of Cottonwood Road as said Cottonwood Road is shown on map of Tract No. 1301, filed May 28, 1946, in the office of the County Recorder of Kern County, in Book 5 of Maps, page 141, more particularly described as follows: Commencing at the northwest corner of Section 33, Township 29 South Range 28 East, M.D.B.& M., Thence S. 0'06'30' W., along the west line of said Section 33, the said west line being also the centerline of said Cottonwood Road of 60.00 feet in width, a distance of 207.75 feet to intersect the easterly extension of the south line of the most northerly alley of 20.00 feet in width, as said alley is shown on said map of Tract No. 1301, the Last-named intersection beim also the true point of beginning; thence S. 89 45' W., along said easterly extension of the southerly line of said alley a distance of 30.00 feet to intersect the west line of said Cottonwood Road; thence S. 0'06'30" W., along said west line of Cottonwood Road a distance of 378.224 feet to intersect a non - tangent curve, from which the radial center of said curve bears S. 70'09'45" E., 937.46 feet; thence northeasterly along said curve concave to the south- east with a radius of 937.46 feet, through a central angle of 8°57'11", an are length of 146.488 feet to intersect the east line of said Cottonwood Road, from which the radial center of the last-named curve bears S. 61'12'34" E., 937.46 feet; thence N. 0'06'30" E., along said east line of Cottonwood Road a distance of 245.27 feet; thence S. 89'28'37" W., a distance of 30.00 feet to intersect the center line of said Cottonwood Road and to the true point of beginning. Excepting and reserving a strip 40.00 feet in width for a public utilities easement, the center line of which is 10.00 feet westerly, as measured at right angles to, and parallel with the center line of said Cottonwood Road. SECTION 3: That it is the intention of the Council of the City of Bakersfield to order the vacation of a portion of Robinson Street in the City of Bakersfield, said portion being more particularly described as follows: Situated in the City of Bakersfield, County of Kern, State of California, being a portion of Section 32, Township 29 South, Range 28 East, M.D.B.& M., more particularly described as follows: Vacating all of Robinson Street of 60.00 feet in width between the westerly extension of the north line of Tenth Street and the westerly extension of the south line of the alley between Eleventh Street and California Avenue, excepting and reserving the above vacation as a Public Utilities Easement, as said alley, streets, and avenue are shown on a map of Tract No. 1301, filed May 28, 1946, in the office of the County Recorder of Kern County, California, in Book 5 of Maps, Page 141. 2. That it is determined by the Council that the public convenience and necessity require the reservation of the afore- mentioned easements and the proceedings are taken subject to such reservations and exceptions. For further particulars as to the proposed vacations, reference is hereby made to maps on file in the office of the City Clerk of the City of Bakersfield, in the City Hall, 1501 Truxtun Avenue, Bakersfield, California. SECTION 4: That the hour of 8:00 o'clock P. M. on the 18th day of October, 1971, in the Council Chambers in the City Hall, 1501 Truxtun Avenue, Bakersfield, California, be and the same is hereby fixed as the time and place when and where all persons interested in or objecting to the proposed vacations may appear before the Council and offer evidence in relation thereto. SECTION 5: That the Superintendent of Streets of the City of Bakersfield is hereby directed to cause "Notice of Street Vacation" to be posted as required by said "Street Vacation Act of 1941," being Division 9, Part 3 of the Streets and Highways Code of the State of California; and the Council of said City hereby elects to proceed under the provisions of said Act for each of the portions of streets described above. SECTION 6: The City Clerk shall certify to the passage of this Resolution, and shall cause the same to be posted on the bulletin board at the City Hall, 1501 Truxtun Avenue, in the City of Bakersfield, California, within fifteen (15) days after its passage. ---------- 000---------- M I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by the Council of the City of Bakersfield at a regular meeting thereof held on the 20th day of September, 1971, by the following vote: 2VET Ca VNCIVe G: 9. ^pC LFA, IESEV, N�FE'E, 'cS ROCKCR.
