A RESOLUTION OF THE COUNCIL OF THE CITY
OF BAKERSFIELD RATIFYING AN EMERGENCY
PROCLAMATION ISSUED BY THE CITY MANAGER AS
DIRECTOR OF EMERGENCY SERVICES.
WHEREAS, the Bakersfield Municipal Code at section 2.40.050 empowers the
Director of Emergency Services/City Manager to proclaim the existence or
threatened existence of a local emergency; and
WHEREAS, a novel coronavirus (named "COVID-19") was first detected in
Wuhan City, Hubel Province, China, in December 2019. The Centers for Disease
Control and Prevention (CDC) considers the virus to be a very serious public health
threat with outcomes ranging from mild sickness to severe illness and death.
COVID-19 has spread globally to over 85 countries, infected more than 95,000
people, and killed more than 7,965 individuals.] and
WHEREAS, on January 30, 2020, the World Health Organization declared the
COVID-19 outbreak a Public Health Emergency of International Concern. On
January 31, 2020, the United States Secretary of Health and Human Services
declared a Public Health Emergency; and
WHEREAS, on March 4, 2020, the Governor of the State of California, Gavin
Newsom, proclaimed a State of Emergency to exist in California as a result of the
threat of COVID-19; and
WHEREAS, on March 13, 2020, the President of the United States, Donald
Trump, declared a national emergency as a result of the threat of COVID-19; and
WHEREAS, on March 16, 2020, Kern County declared a local health
emergency and proclaimed a local emergency; and
WHEREAS, on March 17, 2020, the first case of COVID-19 was confirmed in
Kern County; and
WHEREAS, on March 19, 2020, the Governor of the State of California, Gavin
Newsom, issued Executive Order N-33-20, ordering all individuals in the State of
California to stay home except as needed to maintain continuity of operations of
the federal critical infrastructure sections; and
WHEREAS, on March 19, 2020, City Manager acting as the Director of
Emergency Services proclaimed the existence of a local emergency as a result
of the threat of COVID-19; and

WHEREAS, the City Council has now been asked to ratify the proclamation
of emergency issued by the City Manager.
NOW, THEREFORE, IT IS HEREBY PROCLAIMED AND ORDERED that during the
existence of said local emergency the powers, functions, and duties of the
emergency organization of this City shall be those prescribed by state law,
ordinances and resolutions of this City, and by the City of Bakersfield Emergency
Plan.
1. The above recitals and findings are true and correct and are
incorporated herein by reference.
2. During the existence of said local emergency, the powers, functions,
and duties of the emergency organization of this City shall be those
prescribed by state law, ordinances, and resolutions of this City, and
by any Emergency Plans and/or provisions ratified by City Council.
3. The City Council hereby ratifies the proclamation of emergency by
the City Manager.

I HEREBY CERTIFY that the foregoing Resolution was passed and adopted
by the Council of the City of Bakersfield at a regular meeting thereof held on

does hereby find and proclaims that the conditions of extreme peril to the safety
of persons and property have arisen within the City of Bakersfield, caused by the

serious public health threat presented by the presence and continued
transmission of the novel coronavirus (COVID— 19):and
WHEREAS, the City Council has now been asked to ratify the proclamation

NOW, THEREFORE, IT IS HEREBY PROCLAIMED AND ORDERED that during the
existence of said local emergency the powers, functions, and duties of the
emergency organization of this City shall be those prescribed by state law,
