RESOLUTION NO. 05 1- 2 020 A RESOLUTION OF THE COUNCIL TO VACATE THE 20' ALLEY RUNNING EAST AND WEST BETWEEN STOCKTON STREET AND SACRAMENTO STREET, SOUTH OF MONTEREY STREET IN BLOCK 46 OF THE CITY OF BAKERSFIELD, FORMERLY KNOWN AS THE TOWN OF KERN (WARD 2) WHEREAS, on WEDNESDAY, MARCH 11, 2020, the Council of the City of Bakersfield, pursuant to the provisions of the "Public Streets, Highways and Service Easements Vacation Law," Government Code Sections 8300 et seq. of the Streets and Highways Code of the State of California, declared its intention to vacate the 20' alley running east and west between Stockton Street and Sacramento Street, south of Monterey Street in Block 46 of the City of Bakersfield, formerly known as the Town of Kern (Ward 2); and WHEREAS, the Council did fix a time and place for hearing all persons interested in or objecting to said proposed vacation, which hearing was held on APRIL 8, 2020, after notices of said hearing were duly published and posted as required by law; and WHEREAS, for the above-described project, it was determined that the proposed vacation is exempt from CEQA, pursuant to Section 15061 (b) (3) of CEQA Guidelines (General Rule) in that there is no possibility that the proposed action could have a significant effect on the environment; and WHEREAS, on February 13, 2020, Planning Department found the vacation to be consistent with the Metropolitan Bakersfield General Plan, per local ordinance. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The above recitals are true and correct and are incorporated herein. 2. This Resolution is adopted pursuant to Section 8300, et seq. of the Streets and Highways Code of the State of California. 3. The Council orders the vacation of the 20' alley running east and west between Stockton Street and Sacramento Street, south of Monterey Street in Block 46 of the City of Bakesfield, formerly known as the Town of Kern (more specifically described in Exhibit "A" and illustrated in Exhibit "B", which is attached hereto and incorporated herein), all in the City of Bakersfield, County of Kern, State of California. 4. The City is to reserve a Public Utility Easement (PUE) and access for City services over the vacated area of the 20' alley running east and west between Stockton Street and Sacramento Street, south of Monterey Street in Block 46 of the City of Bakersfield, formerly known as the Town of Kern. 5:\5TREET VACATIONS\Alley tabu Stockton & Sacramento\Resolution Final Heanng.doc O��aK�9T Page 1 of 3 JORIGNAL 5. Per the Bakersfield Fire Department, a 20 foot fire access is still required to be maintained. If gates are installed, the minimum width for manual opening gates shall be 20 feet (6096 mm), and minimum vertical clearance of 13'6" is required when the gate is at full open position and with a Knox pad lock or box installed. Electric gates shall be equipped with a means of opening the gate by fire department personnel for emergency access. Emergency opening devices shall be approved by the fire code official. All new construction of access gates shall be equipped with an automatic opening device which is activated through the wireless activation system utilized on City of Bakersfield owned vehicles for traffic preemption. 6. Gates to be open during working hours of 5:00 AM to 4:30 PM for trash service. 7. California Water Service is requesting that a separate lock be placed on the gate for access to their facilities. This lock is to be approved by California Water Service. 8. Being a portion of the Northwest quarter of Section 29, Township 29 South, Range 28 East, Mount Diablo Base and Meridian, in the City of Bakersfield, County of Kern, State of California, more particularly described as follows: That portion of the 20 foot wide alley within said Block 46 bounded on the West by the Easterly Right of Way line of Stockton Street, 80.00 foot wide, and bounded on the East by the Westerly Right of Way line of Sacramento Street, 80.00 foot wide.
