HomeMy WebLinkAboutRES NO 048-2020RESOLUTION 048-2020NO. 2 U A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD AUTHORIZING THE CITY MANAGER TO PROVIDE FEE DEFERRALS AND OTHER ECONOMIC RELIEF FROM EFFECTS OF COVID-19. WHEREAS, international, national, state, and local health and governmental authorities are responding to an outbreak of respiratory disease caused by a novel coronavirus named "SARS-CoV-2," and the disease it causes has been named "coronavirus disease 2019," abbreviated COVID-19, ("COVID-9"); and WHEREAS, on March 4, 2020, the Governor of the State of California declared a state of emergency to make additional resources available, formalize emergency actions already underway across multiple state agencies and departments, and help state prepare for broader spread of COVID-19; and WHEREAS, on March 13, 2020, the President of the United States of America declared a national emergency and announced that the federal government would make emergency funding available to assist state and local governments in preventing the spread of and addressing the effects of COVID-19; and WHEREAS, on March 17, 2020, the first case of COVID-19 in Kern County was confirmed; and WHEREAS, on March 19, 2020, the Governor of the State of California, Gavin Newsom, issued Executive Order N-3320, ordering all individuals in the State of California to stay home except as needed to maintain continuity of operations of the federal critical infrastructure sections; and WHEREAS, on March 19, 2020, City Manager acting as the Director of Emergency Services proclaimed the existence of a local emergency as a result of the threat of COVID-19; and WHEREAS, on March 25, 2020, the City Council ratified the proclamation of the existence of a local emergency in response to the COVID-19 pandemic at its March 25, 2020 meeting; and WHEREAS, the Centers for Disease Control and Prevention, the California Department of Health and the Kern County Health Officer have all issued shelter in place orders to enforce social distancing, prohibited group events, and taken other precautions to protect public health and prevent transmission of this communicable virus; and Page 1 of 3 Pages A I®O'LMON Of mE COYNOL OF 1FF COY OfEMEYOELDAY OMVN Nf CIfYM ERTOFEOMMFEIDEFERR L MDO1 p ECONOMIC IIEIIEF FROM EFFF Of COMD 19. {YgA C9 T J OH13NAL WHEREAS, as a result of the public health emergency and the precautions recommended by health authorities, many residents and businesses in Bakersfield will experience sudden and unexpected income loss; and WHEREAS, the City of Bakersfield has delayed revising the Master Fee Schedule used to recover reasonable estimated cost for providing services for a full year. NOW, THEREFORE, BE R RESOLVED, by the Council of the City of Bakersfield as follows: 1. The above recitals and findings are true and correct and are incorporated herein by reference. 2. The Bakersfield City Council hereby authorizes the City Manager or his designee to suspend all delinquent fees and related interest for City charges for service and utilities (both commercial and residential), effective immediately, through June 30, 2020, and authorizes the City Manager to extend the date should the City's emergency declaration continue past June 30, 2020. 3. The Bakersfield City Council hereby authorizes the Finance Director or his designee to allow for deferment of payment of transient occupancy tax and waiver of late penalty fees, of collections made through May 31, 2020, delaying payment for that time period until July 1, 2020, and authorizes the City Manager to extend this date should the City's emergency declaration continue past June 30, 2020.
