HomeMy WebLinkAboutORD NO 5007ORDINANCE NO. 5 0 0 7 AN EMERGENCY ORDINANCE AMENDING SECTION 12.56.090 OF THE BAKERSFIELD MUNICIPAL CODE RELATING TO SPECIAL EVENTS PERMIT. WHEREAS, given the impacts of the Covid-19 pandemic on local businesses, the City of Bakersfield has identified a process to help businesses comply with the new "social distancing" requirements mandated by the State as part of the plan to Reopen. The process will allow businesses to apply to temporarily close some private parking lots or public streets/sidewalks within the Downtown area in order to set up outdoor seating and/or vending areas each day; and WHEREAS, the City's existing special event permit process allows local businesses to apply for short-term temporary closures of streets/sidewalks, subject to criteria listed in Chapter 12.56 and in the application. The special event permit process is designed to ensure that the event is successful while taking into consideration the protection of the public's health and safety; and WHEREAS, in light of the Emergency Declaration issued by the City of Bakersfield on March 19, 2020, the City desires to temporarily amended the special event permit application process in Bakersfield Municipal Code Chapter 12.56 to include a COVID-19 Special Event Permit, which will include the closure of streets, sidewalks and parking lots located on private property, for the purpose of using as dining and/or vending space. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: SECTION 1. Section 12.56.090 of the Bakersfield Municipal Code is hereby amended to read as follows: 12.56.090 - Special Events Permit. A. Persons shall apply for a special event permit when: 1. The number of persons for whom the reservation is sought is in excess of three hundred; or 2. The event or activity is open to the general public; or 3. The event or activity will have amplified speech, amplified music, permits for sale of alcoholic beverages or any other special permits or approvals. B. Special event permit applications shall be filed with the director not less than fifteen working days nor more than three hundred sixty-five days prior to the oF0AKF9 T — Page 1 of 2 Pages -- > r f^_ OR13'.IvAL proposed event, activity or use of the park. The director shall not waive the fifteen - day period; provided, however, when it is found to be in the best interests of the administration of the parks, the director may waive such period when the applicant voluntarily waives the appeal rights given in this chapter. C. In light of the Emergency Declaration issued by the City of Bakersfield on March 19, 2020, the City has temporarily amended the special event permit application process to include a COVID-19 Special Event Permit, which will include the closure of streets, sidewalks and parking lots located on private property, for the purpose of using as dining and/or vending space. The COVID- 19 Special Event Permit is subject to Chapter 12.56 and the conditions of the COVID-19 Special Event Permit and application. This subsection will be available until the City's local Emergency Declaration has been rescinded, or until midnight December 31, 2020, whichever occurs first. SECTION 2.
