All UST facilities require the following annual inspections: I. Annual Monitoring Certification of the underground storage tank system - performed by a certified technician employed by a licensed contractor on behalf of the UST owner/operator. 2. Annual Routine UST Inspection - performed by the Kern County Environmental Health Services Department (KCEHSD). Based on this department's records, the aimual monitoring certification was last completed on 03/07/2013. KCEHSD must be notified at least 48 hours prior to testing.Please have your certified contractor schedule the monitor certification with this department. We will make every effort to complete our routine inspection at the same time. During the inspection, the following documents must be available for review: Facility and Tank Registration Forms Monitoring Procedure Plan Site PlotPlan Financial Responsibility Forms Emergency Response Plan Monitoring records The monitor certification is to be scheduled by 04/02/2014 to avoid future enforcement action. Violations of Title 23 of the California Code of Regulations (CCR) are detailed in the following section: VIOLATIONS l. The Respondent is in violation of the California Code of Regulations (CCR) § 2638 (a) for failure to complete the Monitoring Certification every twelve (12) months. The facility is scheduled to complete the Monitoring Certification annually every February. The Monitoring Certification was conducted last year on March 21, 2014, a few weeks past due. Currently the facility is four (4) month past due for 2015. California Code of Regulations (CCR) § 2638 (a): (a) All monitoring equipment used to satisfy the requirements of this article shall be installed, calibrated, operated and maintained in accordance with manufacturer's instructions, and certified every 12 months for operability, proper operating condition, and proper calibration. Written records shall be maintained as required in section 2712. 2. The Respondent is in violation of California Code of Regulations (CCR) § 2638 (d) for failure to submit completed Monitoring System Certification results to this agency within thirty (30) days. The monitoring certification was conducted on March 21, 2014. During the test, the direct bury Diesel spill bucket failed. The owner obtained an Underground Storage Tank (UST) Modification Permit to replace the spill bucket. The new spill bucket was installed and re-tested by a licensed and certified third party testing company on July 18, 2014. The operator has failed to submit passing re-test results to this department. California Code of Regulations (CCR) § 2638 (d): (d) UST owners and operators shall submit a completed "Monitoring System Certi/ication " form to the local agency within 30 days a/ier completion ofthe inspection. 3. The Respondent is in violation of California Code of Regulations (CCR) § 2637 (e) for failure to submit completed secondary containment test results to this agency within thirty (30) days. The secondary containment test was conducted on June 26, 2014. During the test, the piping penetrations failed in Under Dispenser Containment (UDC) 1/2. The owner obtained an Underground Storage Tank (UST) Modification Permit to replace the failed piping penetration test boots. The UDC was repaired and re-tested by a licensed and certified third party testing company. The operator has failed to submit passing test results to this department. California Code of Regulations (CCR) § 2637 (e): (e) Underground storage tank owners and operators shall submit a copy of the test report to the local agency within 30 days of the completion ofthe test. CORRECTIVE ACTIONS The following corrective action shall be completed: ·IMMEDIATELY schedule the Monitoring Certification with a certified International Code Council (ICC) technician and notify the Kern County Public Health Department, Environmental Health Division of the date and time of the testing. ·Within five (5) days of receipt of this notice, submit to the Kern County Public Health Department, Environmental Health Division a completed copy of the Monitoring System Certification and Secondary Containment testing results. The issuance of this Notice of Violation and Order to Correct does not preclude the Kern County Public Health Services Department, Environmental Health Division, from taking administrative, civil or criminal action as a result of the violations noted herein. Documentation from tank, piping, and seal manufacturers of compatibility with these substance(s) must be submitted to Permitting Authority prior to construction. 9.All new construction must meet the requirements to be "product tight" (impervious to the liquid and vapor of the stored product) and have a continuous monitoring system as specified in California Health and Safety code, Chapter 6.7, Section 25290.1. Violations of the California Health and Safety Code (HSC) Section 6.7, 6.95 and Title 23 California Code of Regulations (CCR) are detailed in the following sections and corrective actions necessary to gain compliance are enclosed as well. The facility has failed to come into compliance within the 30 days required. VIOLATIONS 1. California Code of Regulation (CCR), Title 23 § 2712(f). Permit Conditions: Within 30 calendar days ofreceiving an inspection report from either the local agency or the special inspector, the permit holder shall implement the corrections specified in the inspection report and comply with the permit conditions. The corrective action shall include all of the recommendations made by the local agency or special inspector. The local agency may waive the implementation ofany ofthe special inspector 's recommendation based on a demonstration by the permit holder to the local agency 's satisfaction that failure to implement the recommendation will not cause an unauthorized release. The facility is in violation of Title 23 of the California Code of Regulations (CCR) § 2712 (f) for failure to implement corrections within thirty (30) days. Violations were cited during the inspection and after multiple attempts to contact the facility, they have failed to meet the requirements within the 30 day time frame. The facility has been operating outside the scope of the permit for approximately five (5) months. 2. California Code of Regulation (CCR), Title 23 § 2638(a). Annual Certification of Monitoring Equipment: All monitoring equipment used to satisfy the requirements ofthis article shall be installed, calibrated, operated and maintained in accordance with manufacturer's instructions, and certi/ied every 12 months for operability, proper operating condition, and proper calibration. Written records shall be maintained as required in section 2712. The facility has not completed the annual monitoring certification. Testing must be completed every 12 months. The facility is due every February to complete testing. This is a repeat violation. 3. HSC 6.7 § 25284.2. Underground Storage of Hazardous Substances: The owner or operator ofan underground storage tank with a spill containment structure designed to prevent a release in the event ofa spill or overfill while a hazardous substance is being placed in the tank shall annually test the spill containment structure to demonstrate that it is capable ofcontaining the substance until it is detected and cleaned up. The facility has not completed the annual spill bucket test. Testing must be completed every 12 months. The facility is due every February to complete testing. This is a repeat violation. 4. California Code of Regulation (CCR), Title 23 § 2715(a). Certification, Licensing, and Training Requirements for Underground Storage Tank Owners, Operators, Installers, Service Technicians, and Inspectors: By January 1, 2005, owners ofunderground storage tank systems shall submit a signed statement to the local agency indicating that the owner understands and is in compliance with all applicable underground storage tank requirements, and identifying the designated UST operator® for each facility owned. The owner shall inform the local agency ofany change of designated UST operator(s) no later than 30 days after the change. During the course of the 2015 monitoring certification, it was observed that the individual performing the monthly inspections had an expired certification (04/15). The last California Environmental Reporting System (CERS) UST update was in June, 2014 and since then, all designated operator information has expired. An updated form with active certifications needs to be uploaded onto CERS. 5. California Code of Regulation (CCR), Title 23 § 27l5(c)(6). Certification, Licensing, and Training Requirements for Underground Storage Tank Owners, Operators, Installers, Service Technicians, and Inspectors: The designated UST operator(s) shall perform monthly visual inspections ofall underground storage tank systems for which they are designated. The results ofeach inspection shall be recorded in a monthly inspection report. The monthly visual inspection shall include, but is not limited to, the following: (I) Reviewing the alarm history report or log for the previous month, and checking that each alarm condition was documented and responded to appropriately. A copy ofthe alarm history report or log, along with documentation describing action taken in response to any alarm(s), shall be attached to the monthly visual inspection record. (2) Inspecting for the presence ofhazardous substance, water, or debris in spill containers. (3) Inspecting for the presence ofhazardous substance, water, or debris in under-dispenser containment areas, and checking that the monitoring equipment in these areas is located in the proper position to detect a leak at the earliest possible opportunity. (4) Inspecting for the presence ofhazardous substance, water, or debris in containment sumps that, in the past month, have had an alarm for which there is no record ofa service visit, and checking that the monitoring equipment in these containment sumps is located in the proper position to detect a leak at the earliest possible opportunity. (5) Checking that all required testing and maintenance for the underground storage tank system have been completed, and documenting the dates these activities occurred, (6) Verifying that all facility employees have been trained in accordance with subdivision 2715(/) During the course of the 2015 monitoring certification, it was observed that the designated operator had not conducted the employee training for 2014 and 2015. 6. HSC 6.95 § 25508.2. Business and Area Plans: On or befOre the annual due date established pursuant to subparagraph (B) ofparagraph (l) of subdivision (a) ofSection 25508, the business owner, business operator, or o©cially designated representative ofthe business shall review and certY that the information in the statewide information management system is complete, accurate, and in compliance with Section 11022 of Title 42 ofthe United States Code. An annual electronic submittal to the statewide information management system satisfies the certi/ication requirement of this section. The facility has failed to complete their annual CERS submittal. The last submittal was on January 26, 2015. 7. HSC 6.95 § 25514.5(b). Business and Area Plans: Notwithstanding Section 25514, any business that knowingly violates this article a/ier reasonable notice ofthe violation is liable for an administrative penalty, not greater than jive thousand ($5,000) jbr each day in which the violation occurs. Failure to implement corrective action stated within 15 days after receiving this notice may result in the issuance of an Administrative Enforcement Order (AEO), including penalties up to $5,000 per violation, per day. You will also be responsible for re-inspection fees of $115.00 per hour for time spent by department staff.
