A RESOLUTION TO ALLOW THE KERN COUNTY
AUDITOR -CONTROLLER'S OFFICE TO ESTABLISH A
NEW FUND TO COLLECT FISCAL YEAR 2019/2020
CONSOLIDATED MAINTENANCE FEES ON THE TAX
ROLL FOR FISCAL YEAR 2020/2021. (ALL WARDS)
WHEREAS, Chapter 13.04 of Title 13 of the Municipal Code of the City of
Bakersfield provides for a procedure by which the City Council may provide for
the payment of all or any part of the costs and expenses of maintaining and
operating any public improvements which are local in nature, from annual
benefit assessments apportioned among the several lots or parcels of property
within the maintenance district established therefore; and
WHEREAS, on June 28, 2019, City Council adopted Resolution No. 086-19
and No. 087-19 approving and adopting the Public Works Director's Report for the
Consolidated Maintenance District and the fiscal year 2019-2020 budget
confirming park landscaping and street and median landscaping assessments
and authorizing collection of the assessments by the Kern County Tax Collector;
and
WHEREAS, the data for collecting said above assessments for 17,865 parcels
was not transferred to the Kern County Tax Collector's Office for fiscal year 2019-
2020, which resulted in missing assessments totaling approximately $1,100,000. The
Consolidated Maintenance District fees assessments range from $50.00 to $60.00
per parcel; and
WHEREAS, the City wishes to assess and collect the Consolidated
Maintenance District fees for 17,865 parcels that were not transferred to the Kern
County Tax Collector for fiscal year 2019-2020.
NOW, THEREFORE BE IT RESOLVED by the Council of the City of Bakersfield as
follows:
1. The foregoing recitals are found to be true and correct and are
incorporated herein.
2. The Council hereby approves the establishment of a new fund
and authorizes the Kern County Auditor -Controller's Office to
collect the Consolidated Maintenance fees for the above -noted
17,865 parcels on the fiscal year 2020/2021 tax roll.
3. The Public Works Director is hereby directed to file assessments
with the Kern County Tax Collector and the Kern County Tax
Collector is hereby authorized to collect such assessments. These
assessments are exempt from the procedural requirements of
