WHEREAS, on March 2, 2020, a 2011 Scarab Windrow Turner (Compost Turner), equipment number 4505, was reported by the using department as not functioning properly; and WHEREAS, the equipment was inspected by Fleet Services technicians and was determined to have a worn out drum; and WHEREAS, a repair quote was submitted by Resource Machinery & Engineering, detailing the parts and materials needed to bring the equipment back into proper working order, attached hereto and incorporated by reference herein as Exhibif A; and WHEREAS, the parts are only available through the equipment manufacturer, Scarab, and Resource Machinery & Engineering is the factory authorized Scarab dealer (sole source letter attached hereto and incorporated by reference herein as Exhibit B); and WHEREAS, the Public Works Director recommends the Council find that the purchase of the parts and repairs to the Compost Turner can only be obtained from Resource Machinery & Engineering, and recommend the Council dispense with bidding requirements, in accordance with subsection D.2 of Section 3.20.060 of the Bakersfield Municipal Code. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: The above recitals are true and correct and incorporated herein by reference. 2. Based on the facts included in the above recitals, the work, supplies, equipment, and materials and the necessity to successfully repair the windrow turner, as a whole, to function properly can only be provided by the factory authorized Scarab dealer and repair facility, Resource Machinery & Engineering. 3. The Finance Director is authorized to dispense with bidding i�AKF accordance with Section 3.20.060 of the Bakersfield Municipal Code. 0 9N -- Page 1 of 2 Pages -- oa;c,rwA° 4. The expenditure of funds for said work and equipment shall not exceed Ninety Thousand Dollars ($90,000(. 5. The City Clerk shall attest and certify to the passage and adoption of this Resolution and it shall become effective immediately upon its approval.
