SUBJECT: NEPOTISM RULING - DARRELL NICKS
CANDIDATE FOR MOTOR SWEEPER OPERATOR #01347
Dartell Nicks has successfully competed in the Motor Sweeper Operator examination process and placed
on the Eligibility List for same. His Mother -in -Law, Rosa Rubio, is currently employed as a Facility Worker in
the Parks Division of the Recreation and Parks Department. Due to the possibility of Darrell being
considered for promotion to a Motor Sweeper Operator position in the Streets Division of the Public Works
Department, the issue of nepotism must be addressed. Darrell is currently employed as a Solid Waste
Equipment Operator in the Solid Waste Division of the Public Works Department.
The following information has been compiled for your review and determination of whether nepotism
creates an adverse impact on supervision, safety, security or morale.
SUMMARY OF DUTIES
A summary of the duties and responsibilities for the position of Motor Sweeper Operator is as follows: Under
general supervision, performs skilled work involving the operation of motor street sweepers and related
equipment; and performs other work as required.
A summary of the duties and responsibilities for the position of Facility Worker is as follows: Under direct
supervision, performs routine and semi -skilled manual work of limited difficulty in the maintenance and
improvement of: municipal parks and streetscapes including grounds and City buildings, solid waste,
recycling or related areas. Performs a wide variety of manual work related to general maintenance
activities. Employees in this class are not required to drive commercial vehicles. Performs other work as
required.
EMPLOYMENT OVERLAP
According to the Public Works Director, Nick Fidler, if Darrell Nicks is promoted to a Motor Sweeper
Operator position in the Sheets Division of the Public Works Department, performance approisalswould not
be reviewed or conducted by either employee for the other; neither employee would be directly
supervised by the other; and they would not report to each other within the chain of command as they
would be assigned to different departments.
RECOMMENDATION
The Public Works Director, Nick Fidler, and the Human Resources Division recommend approval of the

SUMMARY OF DUTIES
A summary of the duties and responsibilities for the position of Park Services Coordinator is as follows:

Jose Aguilar is competing in the examination process for the position of Fleet Mechanic I. His sister,
Modbel Delgadillo, whom he resides in the same household with, is currently employed as a Secretary
in the Bakersfield Police Department. Due to the possibility of Jose being considered for appointment
to a Fleet Service Mechanic I, in the Fleet Division of the Public Works Department the issue of nepotism
must be addressed. Jose Aguilar is currently employed as a Fleet Service Worker 1 in the Fleet Division
of the Public Works Department.
The following information has been compiled for your review and determination of whether nepotism
creates an adverse impact on supervision, safety, security or morale.
SUMMARY OF DUTIES
A summary of the duties and responsibilities for the position of Fleet Mechanic I is as follows: Under
direct supervision, maintains, repairs and overhauls heavy and light trucks, construction equipment,
automobiles, fire vehicles, police vehicles, small gasoline engines and similar equipment; operates
basic hand, power and shop tools.
A summary of the duties and responsibilities for the position of Secretary I is as follows: Under general
supervision, is responsible for performing secretarial and varied clerical work of considerable difficulty
and performs other work as required.
EMPLOYMENT OVERLAP
According to the Public Works Director, Nick Fidler, if Jose Aguilar is appointed to the Fleet Mechanic
I position in the Fleet Division of the Public Works Department, performance appraisals would not be
reviewed or conducted by either employee for the other; neither employee would be directly
supervised by the other; and they would not report to each other within the chain of command as
they would be assigned to different departments.
RECOMMENDATION

CLASS SUMMARY:
This is an entry-level, multi -departmental classification for use in assigned divisions
and/or sections. Under general supervision, performs semiskilled work in the operation
of light and heavy equipment and complex equipment and performs other work as
required.
REPRESENTATIVE DUTIES:
In addition to the above, the following typical tasks and responsibilities are
representative of the essential duties of the position. They are descriptive, not limiting.
Essential Duties:
Development Services
• Operates trucks, trailers, rear -loading trucks, skid -steer loaders, and other related
equipment;
• Collects trash and debris from homeless encampment sites;
• Identifies and separate personal property from trash for safekeeping, with supervision;
• Logs abandoned property into safekeeping containers, fills out all appropriate
documentation, and returns documentation to Development Services office;
• Removes abandoned property from safekeeping and destroys, when specified, fills
out all appropriate documentation, and returns documentation to Development
Services office;
• Operates skid -steer loader and all other assigned equipment:
• Maintains a professional and respectful demeanor during encounters with the public;
• Ensures all equipment is in good working condition prior to completing assigned work
tickets.
Parks
• Operates a motor grader, skid -steer or bulldozer for leveling and rough grading
in parks;
• Operates a backhoe for removing concrete and rough grading;
• Operates skip loaders loading materials in trucks, or 10 -yard dump trucks for
transporting building and construction materials;
• Drives and operates a variety of specialized equipment such as water pumps,
flush trucks, power trenchers, aerial trucks, disc and landscape blades, flail
mowers, lawn aerators, post hole diggers, concrete saws, pulvi-mixers, three and
seven gang mowers, seeders and fertilizers and other equipment used in park
construction and maintenance and for other public properties;
• Leads and coordinates the work of a group of workers using light equipment on
park construction, cleaning or maintenance; performs manual work with power
tools or hand tools;

• Operates skip loaders loading debris and materials in trucks:
• Operates 10-yard dump trucks for transporting rubble, broken concrete,
construction materials and debris from canals and drainage basins; drives and
operates a variety of specialized equipment such as water pumps, generators,
flush trucks, power trenchers, post hole diggers, concrete saws and other
equipment used in constructing, repairing and maintaining canals, drainage
basins and other City water facilities;
• Leads and coordinates the work of a group of workers using light equipment on
canal improvements, cleaning or maintenance of canals and other City water
facilities.
DISTINGUISHING CHARACTERISTICS
Light Equipment Operator is distinguished from Heavy Equipment Operator in that the
latter functions as the lead worker responsible for the finished product. The Light
