A RESOLUTION DETERMINING THAT THE TASER 7
CONDUCTED ENERGY WEAPON SYSTEM (CEW)
CANNOT BE REASONABLY OBTAINED THROUGH
THE USUAL BIDDING PROCEDURES AND X-Ref.AUQMT 2020--)1b
AUTHORIZING THE FINANCE DIRECTOR TO
DISPENSE WITH BIDDING THEREFORE AND
PURCHASE DIRECTLY FROM THE MANUFACTURER,
AXON ENTERPRISE, INC., NOT TO EXCEED
$1,619,425.19.
WHEREAS, the Bakersfield Police Department (BPD) has utilized CEW systems
manufactured and supplied by Axon Enterprise, Inc. (formerly Taser International) since
1998. Axon Enterprise, Inc. is the only manufacturer that provides a product of this type
which has been studied and litigated; and
WHEREAS, CEW systems have proven to be a valuable asset for BPD personnel
during encounters with violent, resistant, and combative individuals. These devices
provide BPD personnel with a means to safely Incapacitate such individuals while
minimizing risk of injury to officers, suspects, and uninvolved parties, and reduce the need
for other levels of injuring or deadly force; and
WHEREAS, Axon Enterprise, Inc. has released the Taser 7 model of its CEW systems
which provides significant enhancements over previous models to improve de-
escalation, increase safety for officers and combatants, and heighten accountability
through the digital evidence management system; and
WHEREAS, Axon Enterprise, Inc. will provide a trade-in credit of $54,000.00 for
existing Taser hardware owned by the BPD, including devices that have exceeded their
recommended life expectancy. This trade-in credit is reflected in the 5 -year agreement;
and
WHEREAS, Axon Enterprise, Inc. is the sole source provider of the Taser 7
Certification Plan package which includes all hardware, software, licensing, warranties
and accessories, as well as advanced virtual reality training aimed to improve de-
escalation techniques; and
WHEREAS, the Taser 7 CEW system is proprietary in its design and application. Axon
Enterprise, Inc. is the manufacturer and supplier of the BPD'S body -worn camera (BWC)
systems as well as the department's digital evidence management system. The Taser 7
CEW is the only product to seamlessly integrate with this digital evidence management
platform, and it provides automated BWC activation settings during Taser 7 discharge to
further ensure accountability and minimize City liability.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as
follows:

I . The above recitals are true and correct and incorporated herein by
reference.
2. The work, supplies, equipment or materials can only be reasonably
obtained from one vendor because of restricted availability of such work,
supplies, equipment or materials.
3. The Finance Director is authorized to dispense with bidding in accordance
with Section 3.20.060 of the Bakersfield Municipal Code.
4. The expenditure of funds for said work, supplies, equipment or materials
shall not exceed One Million Six Hundred Nineteen Thousand Four Hundred
Twenty -Five Dollars and Nineteen Cents ($1,619,425.19.
