HomeMy WebLinkAboutRES NO 103-2020RESOLUTION NO. 103- 2 0 2 0 A RESOLUTION OF THE BAKERSFIELD CITY COUNCIL DETERMINING THAT THE ABS/SULZER PUMPS CAN ONLY BE REASONABLY OBTAINED FROM ONE VENDOR, FLOW N CONTROL, BECAUSE OF RESTRICTED AVAILABILITY OF SUCH MATERIALS AND AUTHORIZING THE FINANCE DIRECTOR TO DISPENSE WITH BIDDING THEREFOR, IN AN AMOUNT NOT TO EXCEED $62,320.61. RECITALS WHEREAS, the City of Bakersfield )City) owns the Santa Fe Storm Water Lift Station which is designed and outfitted to accept ABS/Sulzer XFP206J dry pit submersible pumps only; and WHEREAS, upon need for replacing worn storm water pumps, City must purchase only ABS/Sulzer brand pumps; and WHEREAS, Flow N Control is the sole integrating representative to the municipal market for ABS/Sulzer products in Southern California; and WHEREAS, the City must purchase replacement ABS/Sulzer Pumps and accompanying components from Flow N Control exclusively; and WHEREAS, ABS/Sulzer is a proprietary product, distributed through Flow N Control, and is therefore a sole source product; and WHEREAS, the Finance Director has determined and has recommended the Council find, that the purchase of ABS/Sulzer products can only be reasonably obtained from one vendor, Flow N Control, because of exclusive representation restricted by the manufacturer and has recommended that this Council authorize dispensing with bidding requirements in accordance with subsection D.2 of Section 3.20.060 of the Bakersfield Municipal Code. NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Bakersfield as of gAKF9� �MI3;hAL follows: 1. The above recitals are true and correct. 2. The Council hereby finds that the purchase of ABS/Sulzer products for the City owned Santa Fe Storm Water Lift Station can only be reasonably obtained from one vendor (Flow N Control) for the reasons set forth above. 3. The Finance Director is authorized to dispense with bidding in accordance with Section 3.20.060 of the Bakersfield Municipal Code. 4. The expenditure of funds for Flow N Control to provide the necessary equipment for the designated storm water lift station shall not exceed Sixty Two Thousand Three Hundred Twenty dollars and Sixty One Cents ($62,320.61). 5. In compliance with the California Environmental Quality Act (CEQA), the City Council finds that the project is exempt pursuant to CEQA guidelines Section 15302(c) which exempts replacement and reconstruction of existing utility systems and/or facilities involving negligible or no expansion of capacity. 6.
