'0-'15 — 2 0 ,2 Q A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD ALLOWING EMERGENCY PROCUREMENT FOR BRUNDANGE LANE NAVIGATION CENTER WHEREAS, City of Bakersfield finds that the number of homeless in our community is significant and increasing, and these persons are without the ability to obtain shelter; and WHEREAS, City of Bakersfield finds that the health and safety of unsheltered persons in the City is threatened by a lack of shelter; and WHEREAS, City of Bakersfield affirms the City's commitment to combatting homelessness and creating or augmenting a continuum of shelter and service options for those living without shelter in our communities; and WHEREAS, in 2018 the voters within the City of Bakersfield approved Measure N, the Public Safety and Vital Services Measure (Measure); and WHEREAS, one of the top community priorities of the Measure was to quickly and sufficiently provide funding toward efforts to reduce the number of homeless individuals within the City; and WHEREAS, City of Bakersfield declared a "shelter crisis" in City Council Resolution No. 143-18 on November 7, 2018; and WHEREAS, on January 22, 2020, the City Council authorized the purchase of the former Calcot Inc. facility at 1900 Brundage Lane with Measure funds to establish the Brundage Lane Navigation Center (BLNC) as a new homeless shelter and completed the purchase on June 16, 2020; and WHEREAS, the City has determined the opening of the BLNC as quickly as possible will have the most immediate impact in reducing the number of homeless individuals within the City; and WHEREAS, the City has previously indicated its target opening date of the BLNC is fall 2020; and WHEREAS, The City Manager declared a local emergency brought on by the threat from COVID-19 pandemic on March 19, 2020 and that action was ratified in City Council Resolution No. 035-2020 on March 25, 2020; and o��AK, Ao r - J WHEREAS, The Centers for Disease Control (CDC) issued special guidance on how to properly prepare and respond to this disease among the homeless population including within emergency shelters; and WHEREAS, Section 2.40 of the Bakersfield Municipal Code governs the actions of the City under an emergency declaration and designates the City Manager as the Director of Emergency Services. This code section ,allows the Director of Emergency Services to make and issue rules and regulations on matters reasonably related to the protection of life and property as affected by such emergency; and WHEREAS, The City of Bakersfield needs to expedite the purchase of goods and services necessary to open the BLNC both in a timely manner and in a configuration that meets the CDC guidance for emergency shelters in response to both the declared shelter crisis and state of emergency; and WHEREAS, The City Council has approved the budgetary limits of the BLNC project and those limits will not be exceeded in any future procurement of the goods or services required for the shelter. NOW THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The above recitals and findings are true and correct and are hereby incorporated fully as a material part of this Resolution. 2. The City Council allows the City Manager as Director of Emergency Services to procure the necessary goods and services to expedite the opening of the Brundage Lane Navigation Center. 3.
