AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AMENDING SECTION 17.06.020 OF
CHAPTER 17.06 (ZONING MAP) OF THE MUNICIPAL
CODE OF THE CITY OF BAKERSFIELD REGARDING
PREZONING OF PROPERTY KNOWN AS THE
ROSEDALE NO. 4 ANNEXATION.
WHEREAS, in accordance with the procedure set forth in
the provisions of Title 17 of the Municipal Code of the City of
Bakersfield, the Planning Commission held a public hearing on a
request by the City of Bakersfield to zone certain property now
being annexed to said City and made several general and specific
findings of fact which warranted a negative declaration of
environmental impact; and
WHEREAS, there appears to be no substantial detrimental
environmental impact which could result from this zoning action;
and
WHEREAS, the proposed zoning substantially conforms to
the General Plan; and
WHEREAS, the City Council has determined after due con-
sideration of the motion and recommendation of the Planning
Commission, herein on file, together with the reasons advanced at
the Planning Commission hearing, that said zoning should be
authorized upon annexation of said property to the City.
NOW, THEREFORE, BE IT ORDAINED by the Council of the
City of Bakersfield as follows:
SECTION 1.
A. All the foregoing recitals are found to be true and
correct.
B. The Negative Declaration for this zoning action is
hereby approved and adopted.
C. That Section 17.06.020 of Chapter 17.06 (Zoning Map)
of the Municipal Code of the City of Bakersfield, be and the same
is hereby amended by extending the boundaries of said map to
include that certain property in the County of Kern located at
the southwest corner of Gibson Street and Burr Street, and con-
tiguous to the boundary of the City of Bakersfield known as the
ROSEDALE NO. 4 ANNEXATION, upon the annexation of said property to
the City of Bakersfield, the boundaries of which property are
shown on the map hereto attached and made a part of this ordinance,
and are more specifically described as follows:
TO AN M-2 (GENERAL MANUFACTURING) ZONE:
All of that portion of the West half of
the West half of Section 26, Township 29
South, Range 27 East, M.D.B.&M., County
of Kern, State of California, lying
between the westerly prolongation of Burr
Street and the south right-of-way of the
Cross Valley Canal, being more particularly
described as follows:
A parcel of land situated in the County of
Kern, State of California, being a portion
of the West half of Section 26, Township 29
South, Range 27 East, M.D.B.&M., more par-
ticularly described as follows:
Beginning at a point of intersection of the
West line of the Southwest quarter of said
Section 26 and the Southerly boundary line
of the Cross Valley Canal, said point of
intersection which bears North 00° 49' 55"
East a distance of 2303.04 feet from the
Southwest corner of Section 26, said point of
intersection being a point on the Existing
Corporate Boundary of the City of Bakersfield;
THENCE (1) departing from the Corporate
Boundary of the City of Bakersfield North
00° 49' 36" East along the West line of the
Southwest quarter of Section 26, a distance
of 343.55 feet to the Northwest corner of the
Southwest quarter of Section 26;
THENCE (2) North 00° 53' 18" East along the
West line of the Northwest quarter of Section
26, a distance of 1025.43 feet to the
Southwest corner of Parcel 3 of Parcel Map
Waiver No. 584 as shown on certificate of
compliance filed in the office of the Kern
County Recorder on November 7, 1985 in Book
5813, Page 2417;

THENCE (3) South 89° 13' 42" East along the
South line of Parcels 2 and 3 of said Parcel
Map Waiver No. 584 and the Easterly prolonga-
tion thereof, a distance of 1322.96 feet to
the point of intersection of the Centerline of
Gibson Street (Co. Rd. No. 1270) and the
Centerline of Burr Street (Co. Rd. No. 1415);
THENCE (4) continuing East along the
Centerline of said Burr Street, a distance of
20 feet to the East line of said Co. Rd. No.
1270, said East line also being on and along
the Existing Corporate Boundary of the City
of Bakersfield;
THENCE (5) South, West and South along various
courses of said Corporate Boundary to the Point
of Beginning.
CONTAINING 35.82 ACRES OF LAND, MORE OR LESS.
Approval of the above zone change is made subject to the
following conditions:
The future "Westside Freeway" alignment shown
on the Circulation Element of the General Plan
Update extends through this annexation area.
The area within the proposed right-of-way for
said freeway shall be included within the last
phase of subdivision development of the property,
and no final map shall be approved for such area
until two years from final approval of this
annexation, unless an alignment of such freeway
which does not cross such area is formally
adopted by the City and County and approved by
CalTrans prior to such time.
The future "Westside Freeway" alignment shown
on the Circulation Element of the General Plan
along the 200 foot alignment adjacent to the
canal as agreed by the developer will not be
used as an area for building or construction
which would obstruct the freeway alignment for
a period of two years, unless an alternative
alignment is approved by the City at which time
it would relieve the condition.

Sewer service shall be provided to the site upon
development or subdivision.
Permanent sewer service is not immediately avail-
able to the site. Prior to any development or
subdivision, plans shall be submitted to and
approved by the City Engineer for sewering the
site so that upon extension of a sewer line from
the west, permanent sewer service can be provided
to the site.
Interim sewer service may be provided by the
developer or subdivider extending the existing
sewer from its westerly terminus in Marriott
Drive to the site. All costs involved in the
extension and any and all costs for a lift sta-
tion and force main, if required, shall be borne
by the developer/subdivider until the permanent
connection is made.
SECTION 2.
This ordinance shall be posted in accordance with the
City Charter provisions and shall become effective upon the
annexation of the above-described territory to the City of
Bakersfield, but not less than thirty (30) days from and after
the date of its passage.

I HEREBY CERTIFY that the foregoing Ordinance was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on May 25, 1988 , by the
