AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AMENDING SECTION 17.06.020 OF
CHAPTER 17.06 (ZONING MAP) OF THE MUNICIPAL
CODE OF THE CITY OF BAKERSFIELD REGARDING
PREZONING OF PROPERTY KNOWN AS THE
CALLOWAY NO. 2 ANNEXATION.
WHEREAS, in accordance with the procedure set forth in
the provisions of Title 17 of the Municipal Code of the City of
Bakersfield, the Planning Commission held a public hearing on a
request by the City of Bakersfield to zone certain property now
being annexed to said City and made several general and specific
findings of fact which warranted a negative declaration of
environmental impact; and
WHEREAS, there appears to be no substantial detrimental
environmental impact which could result from this zoning action;
and
WHEREAS, the proposed zoning conforms to the Bakersfield
Metropolitan Area General Plan and Land Use Element Amendment No.
1-88, Segment I; and
WHEREAS, the City Council has determined after due con-
sideration of the motion and recommendation of the Planning
Commission, herein on file, together with the reasons advanced at
the Planning Commission hearing, that said zoning should be
authorized upon annexation of said property to the City.
NOW, THEREFORE, BE IT ORDAINED by the Council of the
City of Bakersfield as follows:
SECTION 1.
A. All the foregoing recitals are found to be true and
correct.
B. The Negative Declaration for this zoning action is
hereby approved and adopted.
C. That Section 17.06.020 of Chapter 17.06 (Zoning Map)
of the Municipal Code of the City of Bakersfield, be and the same
Rs hereby amended by extending the boundaries of said map to
include that certain property in the County of Kern located at
the southwest corner of Calloway Drive and Hageman Road, and
contiguous to the boundary of the City of Bakersfield known as th~
CALLOWAY NO. 2 ANNEXATION, upon the annexation of said property to
the City of Bakersfield, the boundaries of which property are
shown on the map hereto attached and made a part of this ordi-
nance, and are more specifically described as follows:
TO AN R-1 (ONE FAMILY DWELLING) ZONE:
Lot 1, Lot 2, and those portions of Lot
15 and Lot 16 in Section 19, T.29S.,
R.27E., M.D.B.&M., Kern County,
California, according to the "Sales Map
of Lands of J.B. Haggin" filed August 20,
1890 in the Office of the Kern County
Recorder, being more particularly
described as follows:
Beginning at the northwest corner of said
Lot 15;
THENCE along the north line of said lots,
$89044'44" E, 1,336.66 feet to the north-
east corner of said Lot 16;
THENCE along the east line of said Lot
16, S 00°28'15" W, 668.52 feet;
THENCE N 89039'37" W, 1,337.87 feet to
the west line of said Lot 15;
THENCE N 00°34'41" E along said west
line, 666.54 feet to the Point of
Beginning.
Excepting therefrom the north 600.00 feet
of said Lot 1 and Lot 2.
CONTAINING 42.98 ACRES, MORE OR LESS.
TO AN R-2 (LIMITED MULTIPLE FAMILY)
DWELLING ZONE:
The north 600.00 feet of Lot 1 and Lot 2
in Section 19, T.29S., R27E., M.D.B.&M.,
Kern County, California, according to the
"Sales Map of Lands of J.B. Haggin" filed
August 20, 1890 in the Office of the Kern
County Recorder.

Excepting therefrom the north 385.84 feet
of said Lot 1 and the east 67.00 feet of
the north 385.84 feet of said Lot 2.
CONTAINING 11.88 ACRES, MORE OR LESS.
TO A C-2 (COMMERCIAL) ZONE:
The north 385.44 feet of Lot 1 and the
east 67.00 feet of the north 385.84 feet
of Lot 2 in Section 19, T.29S., R27E.,
M.D.B.&M., Kern County, California,
according to the "Sales Map of Lands of
J.B. Haggin" filed August 20, 1890 in the
Office of the Kern County Recorder.
CONTAINING 6.50 ACRES, MORE OR LESS.
Approval of the above zone change is made subject to the
following conditions:
Project area designated Low Density Residential shall be
restricted along western boundary to minimum lot sizes
of 10,000 square feet, and within the area designated
Medium Density Residential along western boundary no
building of more than one-story shall be allowed within
100 feet of that boundary.
Offers of dedication will be required to allow for
construction to arterial standards of Hageman Road and
Calloway Drive for the full lengths within the GPA area.
Such offers of dedication shall include sufficient
widths for expanded intersections and additional areas
for landscaping as directed by the City Engineer.
The right-of-way width of a standard arterial is 110 feet
with additional widening at intersections and additional
area to permit 10 feet of landscaping behind the combi-
nation sidewalk.

All offers of dedication, fully executed, shall be
submitted to the City prior to development within the
GPA area or recordation of any subdivision map.
All street paving sections are to be determined based on
R-value tests using traffic index values established by
the Traffic Engineer.

Prior to recordation of any subdivision map or issuance
of a building permit, the subdivider/developer shall
dedicate land or pay in-lieu of fees for the development
of neighborhood parks in accordance with North Bakers-
field Recreation and Parks District adopted standards
and the District Service Agreement between that District
and the City of Bakersfield.
The applicant shall initiate either formation of a new
landscape maintenance district or incorporation into an
existing maintenance district prior to recordation of
any subdivision map or issuance of a building permit
within the GPA area.
Upon subdivision or development, the subdivider/developer
shall be responsible for at least half width landscaped
median islands in all arterial streets as directed by
the City Engineer.
Sewer service is available in Rancho Laborde Drive in
the west half of Section 21. Municipal sewer service
shall be provided to any subdivision or development
within this GPA area.
This site is within the Rosedale Community Benefit Area
of the Buena Vista Trunkline Sewer, and prior to
recordation of a subdivision map, all applicable charges
must be paid.
Prior to development or recordation of a subdivision
map, the applicant or its successor shall provide a com-
prehensive traffic study approved by the City Engineer
and enter into an agreement with the City and post
approved security to guarantee payment of his share of
costs involved in traffic signal construction at the
following intersections:
a) Hageman Road & Calloway Drive
b) Meacham Road & Calloway Drive
Payment shall be made to the City upon demand at the
time said funds are required for signal construction.
The applicant or its successor shall make arrangements
with the appropriate utility company to relocate to
their ultimate locations all utility poles within exist-
ing or proposed rights of way, at applicant's or its
successor's cost.

The applicant or its successor shall provide an overall
drainage study and initiate proceedings for a Planned
Drainage Area, if determined necessary Dy the City
Engineer.
The drainage study shall be submitted to and approved by
the City Engineer, the required drainage basin site(s)
and necessary easements deeded to the City, and, if
necessary, the Planned Drainage Area formed prior to
submittal of any subdivision map or development plan
within this area.
A comprehensive sewer study shall be approved by the
City Engineer prior to submittal of a development plan
or subdivision map.
SECTION 2.
This ordinance shall be posted in accordance with the
City Charter provisions and shall become effective upon the
annexation of the above-described territory to the City of
Bakersfield, but not less than thirty (30) days from and after
the date of its passage.
