Resolution in opposition to Proposed Presidential Executive Order allowing foreign vehicles to operate within the United States without adequate environmental protections.(Ward 1) Maggard requested staff assist Council to change the wording in the resolution, "Be it resolved...." paragraph, be changed in a fashion not to oppose the presidents proposal, but to acknowledge that in light of the President's proposal we are in support of a Presidential Order that would require the trucks from Mexico to be subject to the very same standards for safety and air quality that ail other trucks in California. RES 153-02 Bakersfield, California, September 4, 2002 - Page 11 CONSENT CALENDAR continued ACTION TAKEN Couch suggested the last Whereas be stricken, the 5~h Whereas be amended: "to throw" be stricken; Whereas to open the border to "thousands" of trucks from Mexico, not meeting the environmental standards. City Attorney Thiltgen read the changes as follows: "Now therefore be resolved by the Council of the City of Bakersfield that the City Council supports the President's proposal through Executive Order to open the border to foreign trucks but strongly encourages the President to require any foreign trucks meet the safety and environmental standards which are imposed upon the citizens of the State of California." Benham requested the 5th Whereas be amended to: "open the border to truck traffic from Mexico." Motion by Benham to adopt Consent Calendar Item q. as amended. Hearing closed at 8:11 p.m. Motion by Salvaggio to approve expenditure of BJA Local Law Enforcement Block Grant Funds and approve appropriations thereof. Mayor Hall recessed the meeting at 8:13 p.m. and reconvened at 8:20 p.m. ACTION TAKEN APPROVED Continued hearing, Concurrent General Plan Amendment]Zone Change P01/0916:(Ward 4) The City of Bakersfield has proposed a General Plan Amendment and an ordinance amendment for approximately five acres, located at the nodhwest corner of Jewetta Avenue and Brimhall Road. Denial of the zone change has been appealed by staff. Resolution approving the Negative Declaration and adopting the General Plan Amendment to change land use designations from SR ( Suburban Residential) to OC (Office Commercial) First reading of an ordinance adopting the Negative Declaration and overturning the Planning Commission decision by amending Title 17 of the Bakersfield Municipal Code and Zoning Map 101-26 from RS-SA (Residential Suburban - five acres minimum) to C-O/PCD (Professional and Administrative Office Commercial/Planned Commercial Development) on 5 acres. The following individuals spoke in opposition of staff recommendation: Brian Stainfield, Richard Monje, Dennis Mannar, Stan Blair, Thomas Grant, Doug Carter and Phil Gaskill. Couch stated for the record he would be supportive and hopes the Council would be supportive of not only this motion, but if this gentleman chooses to come back to us with an application for R-1 zoning, let's say, something that would be compatible with the neighborhood, he would support that. Motion by Couch to deny the General Plan Amendment and zone change. APPROVED Continued hearing of an ordinance upholding the decision of the Planning Commission, adopting a Negative Declaration and amending Section 17.06.020 (Zone Map No. 103-22) of Title 17 of the Bakersfield Municipal Code by changing the zoning from an R-3 (Limited Multiple Family Dwelling) Zone to PCD (Planned Commercial Development) Zone on 7.5 acres, located on the southeast corner of Mount Vernon Avenue and State Highway 178, appealed by Rich/Matz Bakersfield LLC ( File No. 02- 0263).(Ward 3) Jack Hardisty, Development Services Director, gave a brief update and displayed illustrations. Hearing opened at 8:59 p.m. Tab Johnson, representing Rich/Matz Bakersfield LLC, spoke in support of staff recommendation and requested staff modify Condition No.2., regarding re-striping and re-signing the intersection of Mall View Road and Fashion Place, be amended to allow for permission from property owner, if given permission he will comply, if the permission is not granted he would liked the condition to be waived. Hearing closed at 9:02 p.m. Development Services Director Hardisty recommended the applicant show proof or evidence of a good faith effort to fulfill Condition No. 2, but if denied by the adjacent property owner, he be relieved of that obligation. Motion by Maggard to proceed with staff's recommendation as amended and agreed to by Mr. Hardisty and Mr. Johnson, adopt the Negative Declaration, give first reading of the ordinance. APPROVED Resolution upholding the decision of the Planning Commission approving Revised Vesting Tentative Tract Map 6018 and the Negative Declaration and denying the appeal by the Riverlakes Ranch Master Association. (Ward 4) RES 155-02 Jack Hardisty, Development Services Director, gave a brief update. Hearing opened at 9:05 The following individuals spoke in opposition of staff recommendation: David Stanton, President of Riverlakes Ranch Master Association; and Randall Jackson. The following individuals spoke in support of staff recommendation: Jay Rosenlieb and Randy Berkowitz, Porter-Roberson Engineer. The following individuals spoke in rebuttal in opposition of staff recommendation: David Stanton, President of Riverlakes Ranch Master Association; Debra Howard; Randall Jackson; and Jan Kukula. The following individuals spoke in rebuttal in support of staff recommendation: Jay Rosenlieb and Randy Berkowitz, Porter- Robertson Engineer. Hearing closed at 9:37 p.m. Bakersfield, California, September 4, 2002- Page 15 ACTION TAKEN HEARINGS continued Couch asked Mr. Rosenlieb, for the record, "are your clients willing to offer an irrevocable easement to Coffee Road from the very eastern end of the cul-de-sac. Mr. Rosenlieb responded "yes, we have already publicly stated that a 60 foot wide dedication from this area out to the property line. Couch asked Mr. Rosenlieb if they are willing to make that a condition of the map. Mr. Rosenlieb responded "yes'. Couch asked Mr. Rosenlieb if he would also make the inclusion of a block wall along the northern edge and southern edge of a condition of the map, using the similar style and quality as the wall on South Shore. Mr. Rosenlieb responded "yes". Couch asked if Mr. Rosenlieb would form a Property Owners Association. Mr. Rosenlieb responded "yes". Couch asked Mr. Rosenlieb if they would be willing to make the offer to Riverlakes Homeowners Association, to accept a $5.00 per occupant payment to use lake. Mr. Rosenlieb responded "No, this has not been discussed". Motion by Couch to uphold the decision of the Planning Commission, approving the Revised Vesting Tentative Map 6018 and Negative Declaration and denying the appeal by the Riverlakes Ranch Master Association as amended: · A block wall along South Shore will be along the entire frontage of the subdivision, a previous condition, but the wall will be consistent with the existing wall on South Shore. · A block wall installed between the multi-family and single-family development on both sides of the project, north and south, and that wall will be of similar character and quality as the wall on South Shore; APPROVED 263 ' 64 Bakersfield, California, September 4, 2002 - Page 16 HEARINGS continued ACTION TAKEN · Dedication of a 60 foot right of way to the property line as a condition on this map as an extension of White Water towards Coffee Road. · Maintenance of common areas, pools and recreation areas be provided for by the establishment of a property owners' association. · A crash gate will be installed at the intersection of Whitewater and South Shore. Ordinance adopting the Negative Declaration amending Title 17 of the Bakersfield Municipal Code and Zoning Map 102-18 from R-l-CH (One Family Dwelling-Church) to the Planning Commission recommended C-O/PCD (Professional and Administrative Office Planned Commercial Development) Zone on 7.92 acres located along the southwest corner of Calloway Drive and Noriega Road, appealed by the residents of the area (P01-1036). (Ward 4) FR Hearing opened at 10:20 p.m. Jack Hardisty, Development Services Director, gave a brief update Randy Mishoe spoke in opposition of staff recommendations. The following individuals spoke in support of staff recommendation: Patricia Harbison, representing Coleman Homes and Chuck Adkins. Hearing closed at 10:27 p.m. Motion by Couch to give first reading of the ordinance. APPROVED Mayor Hall recessed the meeting at 10:32 p.m. and reconvened at 10:39 p.m. 10. Bakersfield, California, September 4, 2002 - Page 17 REPORTS ACTION TAKEN City Manager Report No. 3-02 regarding the Aquatic Center and Ice Rink Budget and the Martin Luther King, Jr. Pool and Jefferson Pool budgets. Alan Tandy, City Manager, gave a report regarding funding. Stan Ford, Recreation and Parks Director, gave report regarding programmatic and usage issues. Gino Rosetti, Rosetti Architects, gave an overview of three alternate designs. Motion by Sullivan to move forward with the skating facility and put off making any decision on which plan to move forward with where the water facilities are concerned; put the High School District on the spot, request a definite commitment from them and assurance they will be willing and able to participate; also approve recommendations 2 and 4; direct staff to comeback with an option, if possible, that would allow a viewing stand to be incorporated into design. APPROVED 11. DEFERRED BUSINESS None. 12. NEW BUSINESS None. 13. COUNCIL & MAYOR STATEMENTS Couch stated he will submit his referrals to staff on Thursday. Benham submitted referrals to staff. Benham encouraged everyone to participate in the Houchin Community Blood Bank Drive on Wednesday, September 11, 2002. 266 Bakersfield, California, September 4, 2002 - Page 18 13. COUNCIL & MAYOR STATEMENTS ACTION TAKEN Sullivan requested staff include the three water plans in Friday's packet. Sullivan commended Councilmember Couch for the work he has done with the issues in Ward 4. Maggard requested Mr. Rossetti, Stan Ford, Alan Tandy, and Raul Rojas meet with him after the meeting. Carson announced there will be an information meeting on Tuesday at 5;30, Martin Luther King Jr. Center, staff will be providing information regarding the use of the 2 million dollars, how it can be used, regulations and restrictions. Salvaggio referred a memorandum from Raul Rojas to Alan Tandy regarding the 99~White Lane Interchange Project to see what action the Council can do to try and get Cai Trans on board, and possibly the County or Kern COG can help, and requested a report back. Salvaggio stated appreciation to staff and Couch for their efforts regarding the railroad repair.
