There were no Commissioner comments. Item will be voted on Thursday night. 4.2 Public Hearing Items 4.2a Approval of Extension of Time for Tentative Tract 5518 (Porter-Robertson) (Ward 3) 4.2b Approval of Extension of Time for Tentative Tract 6012 (Porter-Robertson) (Ward 4) Staff reports given recommending approval. There were no Commission comments. Items will be voted on Thursday night. Minutes, PC, September 30, 2002 Page 2 PUBLIC HEARING - Tentative Parcel Map No. 10890 (Dee Jaspar & Assoc.) (Ward 2) Commissioner Sprague had a conflict of interest on this project. Commissioner Tkac was chairman for this portion of the hearing. Staff report given recommending approval. Commissioner Gay asked if there is adequate parking available? Mr. Movius said yes that staff did a parking analysis for the site and the Home Depot site had plenty of parking but staff is requesting further parking analysis depending on the uses that come in on the other pads. There were no other Commissioner comments. Items will be voted on Thursday night. The meeting was turned back over to Commissioner Sprague. PUBLIC HEARING -Vestinq Tentative Tract Map No. 6135 (Porter-Robertson) (Ward 4) Staff reports given recommending approval. The applicant has requested this item be placed on the consent calendar for Thursday night. Commissioner Blockley asked if the conditions applied to this are consistent with the tract to the west? Mr. Movius said yes they are consistent but that will be reviewed when the improvement plan comes in. There were no other Commission comments. Items will be voted on Thursday night. plan PUBLIC HEARING - Receive comments on the adequacy of the Draft Environmental Impact Report for proposed General Plan Amendment and Zone Chanqe 02-0193. The project is a shoppin.q center on 37.52 acres located on the east side of Hiqhway 99 and north of Panama Lane. (Panama 99 Properties, LLC). (Ward 7) Staff report given recommending the Commission refer comments to staff for preparation of a Final EIR. Commissioner Gay asked if they had a concern about traffic and circulation, should they ask staff to review that or wait until December 197 Mr. Movius said that if the Commission has a concern regarding circulation or traffic that they think the EIR did not address adequately, then they should bring it up on Thursday. Commissioner Tragish had a question about the difference in acreage between the land use designations and the zone change request. Mr. Movius said that that is because the general boundary is different. There is a small portion of the site that is already designated general commercial on the general plan. Commissioner Ellison said that in a previous general plan amendment hearing, it was expressed that the model that Kern Cog uses for traffic may be flawed. That they might not be using the correct population. Commissioner Ellison asked if a representative from Kern Cog may be at Thursday's meeting so that they may address their model and the validity of their model? Mr. Grady said that will be the kind of question that staff would want to respond to as part of the preparation of the Final EIR. Minutes, PC, September 30, 2002 Page 3 Commissioner Ellison said that he noticed under the Noise Element that there is going to be a Statement of Overriding Considerations and wondered if there will be more information forthcoming or should they ask questions about it on Thursday? Mr. Movius said they can have their consultant on Thursday go into some detail about the whole concept of a Statement of Overriding Considerations and what the Commission needs to be looking at. Basically, the Planning Commission would determine that the benefits of the project outweigh any of the environmental impacts that cannot be mitigated that still remain as significant. Usually, what happens is that when you get to project approval, staff will provide the Commission with a list that goes through the benefits of the project should they decide to approve it and the Commission will determine if those benefits outweigh the cost to the environment. Commissioner Tragish asked if the most recent revised traffic model from Kern COG was used for this EIR? Mr. Grady said it was not the model used for this EIR. Commissioner Sprague reminded the Commission that Thursday night it is not going to be a time to add conditions onto this project. It will be done at site plan. This is an approval and recommendation back to staff on the EIR. Also, we are not going to be in the position, nor as a Planning Commission do we sit, to review economics of any development that is within the City of Bakersfield. We are here to apply the codes, ordinances and zoning within the general plan. We will not be listening to economic issues of what this project could do to the economics of the City of Bakersfield or what it could do to employees of certain retail units or chain stores. Commissioner Tragish asked staff to inform the Commission when it is feasible to consider economic issues and when they cannot when considering a project. Mr. Grady said he will respond to that on Thursday night. There were no other Commission comments. Items will be voted on Thursday night. PUBLIC HEARING - Receive comments on the adequacy of the Draft Environmental Impact Report for proposed General Plan Amendment and Zone Chanqe 02-0030. The project is a shoppin.q center on 78 acres located on the west side of Gosford Road, between Pacheco Road and Harris Road. (Castle & Cooke, CA Inc.) (Ward 5) Staff report given recommending the Commission refer comments to staff for preparation of a Final EIR. Commissioner Gay asked if Campus Park was notified of the project? Mr. Gauthier said that it was out of the 300 foot boundary. There were no other Commission comments. Items will be voted on Thursday night. 9. PUBLIC HEARINGS - GENERAL PLAN AMENDMENTS AND ASSOCIATED REZONINGS: 9.la&b) GPA/ZC No. P01-0756 (Mclntosh & Associates) (Ward 7) Staff report given recommending the project be denied. Commissioner Tragish in clarifying Mr. Gauthier's comment asked if all four corners were developed commercial, there would be 44.2 acres of commercial on that corner and the Marketplace is 30 acres? Mr. Gauthier said yes. Commissioner Tragish asked how many acres is developed on the four corners east of this project? Mr. Gauthier said he would have an Minutes, PC, September 30, 2002 Page 4 answer by Thursday. It is located one mile away. Commissioner Tragish asked about the policy of the general plan that says it is not recommended to have new commercial built within % mile of each other. He wanted to know if that meant retail to retail? Mr. Gauthier said that is correct and they will go into greater detail on Thursday night. Commissioner Sprague asked if the applicant gave a reason they are requesting C-2 instead of C-1 on this parcel? Mr. Gauthier said no they haven't and he can ask the applicant that on Thursday night. There were no other Commission comments. Items will be voted on Thursday night. 9.2) General Plan Amendment No. P02-0623 (Mclntosh & Associates) (Ward 3) Commissioner Sprague had a conflict of interest on this project. Commissioner Tkac was chairman for this portion of the hearing. Staff report given recommending denial of the project. Commissioner Tragish asked it would be appropriate to approve this general plan amendment but determine that it would not be an arterial but it would still have to be built as a collector? Mr. Gauthier said yes. Commissioner Tragish asked what the applicant's reasoning is for deleting it besides the fact they don't want to pay for a road that goes through a hilly area? Mr. Gauthier said that is the basis but they are not offering an alternative or secondary road, they just want this one to go away so staff is recommending denial. Even a two lane to connect the area would be o.k. Commissioner Gay said that without another option, he would not support deleting Masterson. He asked what happens in the open space? Mr. Gauthier said the open space designation tells you that there is a constraint. It will get built differently but it does not mean you can't build there and there will be a need for a road. Commissioner Tragish asked if this road were built as a collector if it is mandatory that bicycle lanes be built also? Mr. Gauthier said no. The City has a bicycle master plan that determines where bike lanes are built. There were no other Commission comments. Items will be voted on Thursday night. The meeting was turned back over to Commissioner Sprague. 10. COMMUNICATIONS: Mr. Grady announced to the Commission that the second meeting for the joint City/County Planning Commission on the general plan wherein the Commissioners will be recommending action on certification of the EIR and approval of the general plan amendment will be on October 28.
