August 12, 2020 Bakersfield City Council Meetings
On March 18, 2020, Governor Gavin Newsom issued Executive Order N-29-20,
which includes a waiver of Brown Act provisions requiring physical presence of
the Council or the public in light of the COVID-19 pandemic.
Based on guidance from the California Governor's Office and Department of
Public Health, as well as the County Health Officer, in order to minimize the
potential spread of the COVID-19 virus, the City of Bakersfield hereby
provides notice that as a result of the declared federal, state, and local health
emergencies, and in light of the Governor's order, the following adjustments
have been made:
1. The meeting scheduled for August 12, 2020, at 3:30 p.m. will have limited
public access.
2. The meeting scheduled for August 12, 2020, at 5:15 p.m. will have limited
public access.
3. Consistent with the Executive Order, Councilmembers may elect to
attend the meeting telephonically and to participate in the meeting to
the same extent as if they were physically present.
4. The public may participate in each meeting and address the City Council
as follows:

A staff memorandum was received correcting an error in the
Comparable City Research matrix and transmitting
correspondence received.
City Manager Clegg made staff comments.
Development Services Director Boyle made additional staff
comments and provided a PowerPoint presentation.

The following individuals spoke in opposition to amending the
ordinance to allow backyard hens in residential areas: Joseph
Kandle; Kenneth Hersh; and Gary Simmons.
The following individuals spoke in favor of backyard hens in
residential areas: Ryan Denbosky; Zoe Pelishek; Maddie Pelishek;
Cessy Mangum; MT Merickel (submitted written material); Becky
Pelishek; Kevin Lugo; Kirk Boland (submitted written material); Bruce
Bagwell; Benjamin Vinluan; and Alex Dulay.
Keith Nettleton made comments regarding a separate subject.
Councilmember Smith requested the Legislative and Litigation
Committee review BUBH guidelines and draff an ordinance with the
first reading to be presented at the September 23rd City Council
meeting.
Motion by Councilmember Smith to receive and file the update
with the direction that staff is to work on the proposed ordinance,
after it has been discussed in the Legislative and Litigation
Committee, following BUBH guidelines, and return for Hirst reading of
the ordinance at the September 23rd City Council meeting. Motion
passed with Vice -Mayor Parlier absent, and Councilmembers Weir
and Freeman voting no.
b. Quarterly update from the Bakersfield -Kern Regional Homeless
Collaborative (BKRHC) on Homeless System Performance Metrics.
(Staff recommends to receive and file.)
City Manager Clegg announced this item will be heard at the
September 9th City Council meeting.
4. CLOSED SESSION
a. Conference with Labor Negotiator pursuant to Government Code
section 54957.6.
Motion by Councilmember Smith to adjourn to Closed Session at
5:04 p.m. Motion passed with Vice -Mayor Parlier absent.

cul-de-sac walls along the south side of 241h Street upon the
completion of the 24th Street Improvement Project.
Councilmember Gonzales requested staff identify a funding source
for the completion of the block wall along the south side of 241h
Street, review the design, and return to Council for consideration at
a future meeting.
e. The following individuals emailed comments expressing concern
with the City's efforts to protect victims of identity theft, domestic
violence victims, and the confidentiality of addresses: the

b. Public Hearing to consider General Plan Amendment/Zone
Change No. 19-0184 (Appeal). McIntosh & Associates, representing
Nicholson Combs, LLC (property owner), is proposing a General
Plan Amendment/Zone Change located east of Old River Road
between Panama Lane and Empire State Drive. The request
includes: (1) an amendment to the Metropolitan Bakersfield
General Plan Land Use Element designation from LR (Low Density
Residential) to LMR (Low Medium Density Residential) or a more
restrictive designation on 16.89 acres; and (2) a change in zone
classification from R-1 (One Family Dwelling) to R-2 (Limited Multiple
Family Dwelling) or a more restrictive classification on 16.89 acres.
McIntosh & Associates submitted an appeal of the Planning
Commission's decision to deny the proposal. Mitigated Negative
Declaration on file if the Council elects to grant the appeal
(GPA/ZC No. 19-0184).
(City staff recommends upholding the appeal and adding conditions as
presented herein.)

Mayor Goh stated this item was opened and continued from the
July 15th City Council meeting.

a. Coronavirus Aid, Relief, and Economic Security (CARES) Act
Funding Overview:
1. Plan Overview
2. Appropriate $7,692,040 to the CARES COVID Relief Fund
operating budget for Fiscal Year 2019-20.
3. Appropriate $25,810,366 to the CARES COVID Relief Fund
operating budget for Fiscal Year 2020-21.
(Staff recommends approval of the plan, authorizes staff to implement as deemed
necessary and approves the two appropriations.)
City Clerk Drimakis announced a staff memorandum was received
transmitting correspondence regarding item 13.a.
Councilmember Gonzales stated he will abstain from this item in an
abundance of caution, due to a potential conflict of interest, and
left the chambers at this time.
City Manager Clegg made staff comments.
Assistant City Manager Huot made additional staff comments and
provided a PowerPoint presentation.
Councilmember Rivera left the meeting at 6:30 p.m.
Motion by Councilmember Freeman to approve the staff
recommendation. Motion passed with Councilmember Rivera and
Vice -Mayor Parlier absent, and Councilmember Gonzales
abstaining.
14. COUNCIL AND MAYOR STATEMENTS
Mayor Goh acknowledged Alexsia Drulias, Senior at Garces Memorial
High School, in recognition of receiving the Mayor's Trophy award.
Mayor Goh stated she had the pleasure of participating in the ribbon
cutting ceremony for Superior Grocers, located at Union Avenue and
California Avenue.
Mayor Goh recognized Miriam Kann on the celebration of her 103rd
birthday.
