A RESOLUTION OF THE BAKERSFIELD CITY COUNCIL
AUTHORIZING THE FINANCE DIRECTOR TO DISPENSE WITH
FORMAL BIDDING PROCEDURES AND MAKE FINDINGS IN
ACCORDANCE WITH CALIFORNIA GOVERNMENT CODE
SECTION 4217.12 ET SEQ. TO ENTER INTO AN ENERGY
SERVICE CONTRACT WITH ADVANCED LIGHTING SERVICES,
INC. TO PROVIDE TURNKEY SERVICES TO CONVERT THE
EXISTING HIGH PRESSURE SODIUM, FLOURESCENT AND
METAL HALIDE FIXTURES AT THE DESIGNATED CITY PARKS
AND FACILITIES TO LIGHT EMITTING DIODE (LED) FIXTURES,
NOT TO EXCEED $802,600
WHEREAS, Government Code section 4217.10, et seq., authorizes a public
agency to enter into an energy service contract without going through a formal bid
process if its governing body determines, at a regularly scheduled public hearing,
public notice of which is given at least two weeks in advance, that (1) it is in the best
interest of the City to enter into such energy service contract, and (2) if the City finds
that the anticipated cost to the City for the electrical energy or conservation services
provided by the energy conservation facility under the contract will be less than the
anticipated marginal cost to the City of electrical energy that would have been
consumed by the City in the absence of those purchases; and
WHEREAS, the City of Bakersfield has approximately over 2,000 high pressure
sodium, fluorescent or metal halide light fixtures in City Parks that need to be
converted to LED fixtures; and
WHEREAS, Advanced Lighting Services, Inc. is a national firm that specializes in
turnkey energy efficiency projects; and
WHEREAS, Advanced Lighting Services, Inc. previously worked with the City of
Bakersfield as Pacific Gas and Electric's sub -contractor who converted 12,860 high
pressure sodium City of Bakersfield cobra head street light fixtures to LED in 2018; and
WHEREAS, Advanced Lighting Services, Inc.'s pricing and costs provided to the
City are based on working extensively with City staff to audit the existing light fixtures
at City parks and facilities and determine the best and most economical and energy
efficient LED conversion; and
WHEREAS, based on the energy cost analysis provided by Advanced Lighting
Services, Inc. attached to the proposed contract as Exhibit A, City staff estimates an
annual ongoing energy savings of $102,000.00 after all City light fixtures at the
designated City parks and facilities are converted to LED; and

WHEREAS, the breakdown of Advanced Lighting Services, Inc.'s cost to convert
the light fixtures at the designated City parks and facilities to LED fixtures is
approximately $802,600; and
WHEREAS, Advanced Lighting Services, Inc. secured an On Bill Financing (OBF)
Loan from Pacific Gas & Electric (PG&E) and City staff believe it is unlikely that any
other contractor would have been able to secure the zero percent interest loan from
PG&E; and
WHEREAS, OBF funding is provided by The California Public Utility Commission
and PG&E acts as the administrator of these funds and the City would pay back the
zero percent interest loan through energy savings realized by the improvements until
the loan is fully repaid; and
WHEREAS, Since the OBF loan is paid back using energy savings and the OBF
program provides upfront improvement costs, there is no fiscal impact to the City;
and
WHEREAS, the Public Works Department recommends the Council authorize
the Finance Director to dispense with bidding for this energy efficient/conservation
project and approve the agreement with Advanced Lighting Services, Inc. to
convert the high-pressure sodium, fluorescent and metal halide light fixtures at the
18th and Eye Parking Garage, City Hall North underground parking, and the following
City Parks: Beach Park, Campus Park South, Greystone Park, Grissom Park, Haggin
Oaks Park, Jastro Park, Jefferson Park, Lowell Park, The Park at River Walk, Planz Park,
Silver Creek Park, Wayside Park and Wilderness Park; and
WHEREAS, the City Council finds and determines that it is in the best interest of
the City to enter into a contract with Advanced Lighting Services, Inc. for the
proposed improvements.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as
follows:
1. The City Council finds and determines that the above recitals are true
and correct and incorporated herein by reference.
2. This resolution is adopted following a public hearing at a regularly
scheduled meeting of the City Council for which a minimum of two weeks public
notice has been duly given.
3. The City Council finds that (1) it is in the best interest of the City to enter
into an energy service contract with Advanced Lighting Services, Inc. for the

implementation of certain energy related improvements to City facilities, and (2) the
anticipated cost to the City for electrical energy or conservation services provided
by the conservation facility under the contract will be less than the anticipated
marginal cost to the City of electrical energy that would have been consumed by
the City in absence of those purchases.
4. The Finance Director is authorized to dispense with bidding therefor in
accordance with Government Code section 4217.10, et seq., and authorizes the City
to enter into an energy service contract with the Advanced Lighting Services, Inc. in
an amount not to exceed $802,600.

HEREBY CERTIFY that the foregoing Resolution was passed and
