Exempt pursuant to Code 27383 DOCUMENT ELECTRONICALLY RECORDED IN TIE OFFICIAL RECORDS The undersigned Grantor(s) declare(s) that the DOCUMENTARY TRANSFER TAX IS: $ 0 Grantee is Exempt Gov't Agency(R&T 11922) RESOLUTION NO. 167-2020 A RESOLUTION OF THE COUNCIL TO VACATE A PORTION OF THE NORTH/SOUTH ALLEY ADJACENT TO THE EAST OF 266 JEFFERSON ST (WARD 2) � m r v U ORIGNRAL RESOLUTION NO. 16.7 --2020 A RESOLUTION OF THE COUNCIL TO VACATE A PORTION OF THE NORTH/SOUTH ALLEY ADJACENT TO THE EAST OF 266 JEFFERSON ST (WARD 2) WHEREAS, on WEDNESDAY, September 23, 2020, the Council of the City of Bakersfield, pursuant to the provisions of the "Public Streets, Highways and Service Easements Vacation Law," Government Code Sections 8300 et seq. of the Streets and Highways Code of the State of California, declared its intention to vacate a portion of the north/south alley adjacent to the east of 266 Jefferson Street (Ward 2); and WHEREAS, the Council did fix a time and place for hearing all persons interested in or objecting to said proposed vacation, which hearing was held on OCTOBER 21, 2020, after notices of said hearing were duly published and posted as required by law; and WHEREAS, for the above-described project, it was determined that the proposed vacation is exempt from CEQA, pursuant to Section 15061 (b) (3) of CEQA Guidelines (General Rule) in that there is no possibility that the proposed action could have a significant effect on the environment; and WHEREAS, on August 18, 2020, Planning Department found the vacation to be consistent with the Metropolitan Bakersfield General Plan, per local ordinance. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: The above recitals are true and correct and are incorporated herein. 2. This Resolution is adopted pursuant to Section 8300, et seq. of the Streets and Highways Code of the State of California. 3. The Council orders the vacation 'of a portion of the north/south alley adjacent to the east of 266 Jefferson Street'(more specifically described in Exhibit "A" and illustrated in Exhibit "B", which is attached hereto and incorporated herein), all in the City of Bakersfield, County of Kern, State of California. 4. The City is to reserve a Public Utility Easement (PUE) and access for City services over the vacated area of north/'south alley adjacent to the east of 266 Jefferson Street. 5. There is a fire hydrant located at the northeast corner of 266 Jefferson Street and the alley. Fire hydrant has to remain in the open and not enclosed by any future fence or wall. Sufficient space around the fire hydrant, as directed by the City of Bakersfield Fire Department, is to:be maintained for any future fence or wall. Being a portion of the Southwest quarter of Section 20, Township 29 South, Range 28 East, Mount Diablo Base and Meridian, in the City of Bakersfield, County of Kern, State of California, more particularly described as follows: That portion of the 25 -foot -wide alley within said Block 6 bounded on the North by the Easterly prolongation of the North line of Lot 32 of said Block 6 to the West line of Lots 33 thru 44 of said Block 6 and bounded on the South by a line from the Southeast corner of Lot 32 to the Southwest corner of Lot 33 of said Block 6. RESERVING therefrom pursuant to the provisions of the Section 8340 of the Streets and Highways Code and for the benefit of all utility companies including the City of Bakersfield, a permanent PUE (Public Utilities Easement) and the right at any time and from time to time to construct, reconstruct, maintain, operate, replace, remove, repair, renew and enlarge lines of pipes, conduits cables, wires, poles, electrical conductors and other equipment, fixtures and appurtenances for the operation electric, gas and communication, water, sewer facilities and all other utilities, including access, and also the rights to trim and cut down trees and brush that may be a hazard to the facilities; said area shall be kept open and free of buildings, structures and wells of any kind.
