A RESOLUTION APPOINTING MICHAEL PAYNE TO THE
POLICE CIVIL SERVICE COMMISSION FOR A SPECIAL
PURPOSE.
WHEREAS, the rules regarding appointment of Bakersfield Police Civil
Service Commissioners are set forth in Bakersfield City Charter Section (221)1; and
WHEREAS, the Bakersfield City Council appointed Mike Payne on
December 14, 2016 to the Bakersfield Police Civil Service Commission; and
WHERAS, Commissioner Payne served in that capacity for three years,
during which time he sat as a member of the Commission for the Appeal In The
Matter of: Christopher Messick v. City of Bakersfield (et al.) which took place from
January 28, 2019 through January 31, 2019; and
WHEREAS, Commissioner Payne was one of three votes upholding the
termination of Christopher Messick on February 14, 2019; and
WHEREAS, Christopher Messick appealed the termination to the Kern
County Superior Court and the Honorable Eric Bradshaw recently ruled that said
Hearing must be re -opened for a limited purpose; and
WHEREAS, the Council recognizes that although there are no Police Civil
Service Commissioner vacancies to be filled at the moment, there is a need to
appoint Mr. Michael Payne for the purpose of fulfilling the Court Order; and
WHEREAS, Michael Payne agrees to serve as a Police Commissioner for the
sole purpose of fulfilling the Court Order; and
WHEREAS, Mr. Payne's appointment will expire at the conclusion of said
Police Civil Service Appeal.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield
as follows:
1. The above recitals are true and correct and incorporated herein by
reference.
2. This resolution shall become effective and in full force upon final
passage.
