AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD ADDING SECTION 17.64.038 TO THE
BAKERSFIELD MUNICIPAL CODE RELATING TO
GARAGE CONVERSIONS.
BE IT ORDAINED by the Council of the City of
Bakersfield as follows:
SECTION 1.
Section 17.64.038 is hereby added to Chapter 17.64 of
the Bakersfield Municipal Code to read as follows:
17.64.038 Garage conversions.
A. Notwithstanding any other provision of this title
and subject to the exceptions set forth in this subsection and
subsection B., upon written application filed with the Planning
Director, a permit may be issued by the Planning Director to the
owner of any single-family residence having a garage which has
been converted into living space attached to the residence. No
permit may be issued for any residence less than ten (10) years
old. Such permit shall be issued only if off-street parking,
within or behind the front yard setback, is otherwise available on
the property and the Planning Director finds that no special on-
street parking problems exist in the vicinity of the lot or par-
cel.
B. No such permit shall be issued in any circumstance in
which the Planning Director determines that off-street parking
behind the front yard setback, other than in the garage, may
reasonably be provided on the lot or parcel, unless such parking
is in fact provided, improved to City standards.
C. No garage converted into living space shall be util-
ized as a second dwelling unit on the lot or parcel, and no condi-
tional use permit under this title shall be issued permitting such
use.
D. Fees for garage conversion permits shall be set in
accordance with the procedures of Chapter 3.70.
E. Final approval of the garage conversion shall be by
the Building Director upon inspection of the work completed in
accordance with construction permits issued therefor, and any con-
ditions of approval by the Planning Director.
F. The decisions of the Planning Director under subsec-
tions A. or B. may be appealed to the Council for hearing, provided
notice of appeal is filed with the City Clerk within ten (10) days
of mailing of notice of the Planning Director's decision. Notice
of the Director's decision shall be mailed to the applicant and to
the record owner of each contiguous parcel or lot within the same
block. No other notice shall be required. The decision of the
Council after the close of the hearing shall be final.
G. If a permit for a garage conversion has been issued
pursuant to this section for any lot or parcel, no modification
reducing the front-yard setback shall be approved for any carport
or other structure on such lot or parcel.
H. No permit shall be issued for a garage conversion
completed after December 31, 1987; this section is automatically
repealed two (2) years from the effective date of the ordinance
adopting this section.
SECTION 2.
This ordinance shall be posted in accordance with the
City charter provisions and shall become effective thirty (30)
days from and after the date of its passage.
