Hearing
After discussion, a motion, by Roland Maier and seconded by Commissioner Nila Hogan
to appoint the Honorable Gary Freedman as the Hearing Officer for a Personnel Appeal
Hearing to be held on February 15t -5th, 2021 from 4-8pm each day.

Christi Tenter thanked the Board for their attendance. Christi Tenter also asked the Board
for referrals to fill a vacant seat on the Miscellaneous Civil Service Commission.

SUBJECT: NEPOTISM RULING- CATHARINE THOMSON
CANDIDATE FOR ADMINISTRATIVE ANALYST 1/11 #01382
Catharine Thomson has successfully competed in the examination process for the position of Administrative
Analyst 1/11 and placed on the eligibility list for same. Her daughter-in-law, Kimberly Searcy, is currently
employed as a Police Service Technician in the Police Department. Due to the possibility of Catharine being
considered for the Administrative Analyst 1/11 position, the issue of nepotism must be addressed.
The following information has been compiled for yourreview and determination of whether nepotism creates
an adverse impact on supervision, safety, security or morale.
SUMMARY OF DUTIES
A summary of the duties and responsibilities for the position of Administrative Analyst 1/11 is as follows: Under
direction, to assist in providing administrative and budgetary guidance to department head and
departmental administrative personnel regarding City services and business affairs; to conduct administrative
studies and analyses; to submit recommendations and prepare reports; and to do related work as required.
A summary of the duties and respons i bii !ties for the position of Police Service Technician; is as follows: Under
general supervision as an unarmed, non -sworn employee, performs work of average difficulty involving
specific phases of police work on an assigned shift and performs other work as required.
According to Nick Fidler, Public Works Director, if Catharine Thomson is appointed to the Administrative
Analyst position in the Public Works Deportment, performance appraisals would not be reviewed or
conducted by either employee for the other; neither employee would be directly supervised by the other;
and they would not report to each other within the chain of command as they would be assigned to
different departments.
RECOMMENDATION
The Public Works Director, Nick Fidler, and the Human Resources Department recommend approval of the
nepotism. If this request is approved, however, nepotism considerations may adversely affect future
appointments, transfers or promotional opportunities.

Austin Charles is competing in the examination process for Clerk Typist 1/11. His father-in-law, Matthew
Arambula, is currently employed as a Streets Equipment Operator in the Streets Division of the Public Works
Department, Due to the possibility of Austin being considered for the Clerk Typist 1/11 position, the issue of
nepotism must be addressed and reviewed prior to appointment.
The following information has been compiled for your review and determination of whether nepotism
creates an adverse impact on supervision, safety, security or morale.
SUMMARY OF DUTIES
A summary of the duties and responsibilities for the position of Clerk Typist 1/11 is as follows: Clerk Typist 1:
Under immediate supervision, performs routine and repetitive typing and clerical duties; and performs
other work as required. Clerk Typist 111: Under general supervision, performs general typingi and a variety of
moderately difficult clerical work; and performs other work as required.
A summary of the duties and responsibilities for the position of Streets Equipment Operator are as follows:
Under general supervision, performs semi -skilled work in the operation of heavy and complex automotive
equipment such as graders, b,ackhoes, and heavy dump trucks; front loading dump trucks, clamshell skip
loaders, and performs other work as required.
EMPLOYMENT OVERLAP
If Austin Charles is appointed as a Clerk Typist 1/11, in any division/department other than the Streets
Division of the Public Works Department there would be no potential for creating an, adverse impact on
supervision, safety, security or morale, or involve a significant potential for conflict of interest. Performance
appraisals would not be reviewed or conducted by either employee for the other, neither employee
would be directly supervised by the other and they would not report to each other within the chain of
command as they would be assigned to different divisions/departments,

evaluates employee performance; recommends progressive discipline; prepares technical reports,
correspondence and other written materials; maintains records; identifies and resolves problems; performs
administrative analyses in support of department or division activities; responds to emergencies and public
inquires; participates in budget preparation; participates in the development and implementation of
goals, objectives, policies, procedures and work standards; performs special projects or other work as
required.
EMPLOYMENT OVERLAP
If Victoria Gutierrez is appointed as a Clerk Typist 1/11, in any division/department other than; the
Wastewater Division of the Public Works Department there would be no potential for creating an adverse

Division of the Public Works Department there would be no potential for creating an adverse impact on

A summary of the duties and responsibilities for the position of Facility Worker are as follows: Under direct
supervision, performs routine and semi -skilled imanual work of limited difficulty in the maintenance and
improvement of: municipal parks and streetscapes including grounds and City buildings, solid waste,
recycling or related areas. Performs a!, wide variety of manual work related to general maintenance
activities. Employees in this class are not required to drive commercial vehicies. Performs other work as
required.
EMPLOYMENT OVERLAP
If Corine Parsons is appointed as a Clerk Typist 1/11, in any division/departiment other than the General
Services Division of the Public Works Department there would be no potential for creating an adverse
impact on supervision, safety, security or morale, or involve a significant potential for conflict of interest.
Performance appraisals would not be reviewed or conducted by either employee for the other, neither
employee would be directly supervised by the other and they would not report to each other within the
chain of command as they would be assigned to different divisions/departments.

Human Resources Department is recommending the reclassification of one (1)
Administrative Analyst 11 position to the classification of Business Manager, Upon
review and assessment of the employee's job duties, it has been determined that
the employee is performing the duties within the job scope of the Business Manager
classification:
"Under general direction, acts as departmental administrative officer for a
major City department; coordinates, makes recommendations for action
and advises department head in developing, implementing, and
monitoring operating, capital improvement, and other budgets; performs
complex and difficult administrative, financial, statistical, and other
management analyses in support of activities and functions of a City
department; supervises staff; performs related work as required."
In 2014, the position was reclassified to an, Administrative Analyst I due to growing
analytical and fiscal -related duties required of the position. At that time, the
position began assisting with citywide rates and inventory related to technology
needs. Today, each department has a key reliance on technology.
With adoption of the 2020-2021 budget Technology Services was appointed as a
department within the City's organization structure. While previously an operating
division of the City Manager's Office, the growing staff, inventory, vendor
management and capital projects continue to expand and evolve which require a
dedicated position to act as the departmental administrative officer in fiscal,
administrative and budget matters. The current incumbent provides these functions
in addition to having a deep understanding of the citywide budget in order to
develop and allocate rates to departments. These align with the duties, skills and
abilities of the Business Manager classification.
Therefore, based on the above, I recommend this employee be reclassified from
Administrative Analyst 11 to a Business Manager due of the ownership of the fiscal
and administrative programs for the Technology Services Department.
If certified, the recommendation will be presented to the City Council for final
determination at the November 17, 2020 meeting.
