RESOLUTION OF THE COUNCIL OF THE -CITY OF
BAKERSFIELD DISPENSING WITH BIDDING PROCEDURES
DUE TO AN EMERGENCY RENTAL OF A TEMPORARY
CHILLER AT THE BAKERSFIELD POLICE DEPARTMENT'S
HEADQUARTERS DOWNTOWN AND INSTALLATION OF
A 155 TON EMCOR SERVICES HILLCREST CHILLER AT
THE BAKERSFIELD POLICE DEPARTMENT'S
HEADQUARTERS DOWNTOWN FOR AIR CONDITIONING
SERVICES.
WHEREAS, The existing chiller in the Bakersfield Police Department's (BPD)
Headquarters downtown was installed in 2000; and
WHEREAS, On September 20, 2020 the chiller at the BPD's Headquarters
downtown was no longer operational and deemed not cost effective to repair;
and
WHEREAS, Air conditioning and ventilation is not available for the entire BPD's
Headquarters downtown including the basement, first and.second floor offices
without an operable chiller; and.
WHEREAS, Staff contacted TRANE, a commercial HVAC contractor, to rent a
temporary chiller so that air conditioning and ventilation is available at the BPD's
Headquarters Downtown; and
WHEREAS, TRANE can provide a temporary chiller for three (3) months or until
a new chiller is installed for a not to exceed cost of $54,500; and
WHEREAS, Staff contacted EMCOR Services Hillcrest a commercial HVAC
contractor experienced in commercial chiller replacement and available to
perform the chilleri replacement; and
WHEREAS, EMCOR Services Hillcrest requires two (2) weeks to ship the chiller
once the contract is approved and an additional one and a half (1.5) weeks for
installation; and
WHEREAS, Getting formal bids the chiller replacement at the BPD's
Headquarters downtown through the normal bidding procedures will delay delivery
and installation .of the unit which will affect air conditioning and ventilation for the
afore mentioned offices in the BPD's Headquarters downtown.

NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as
follows:
1. The above recitals are true and correct and incorporated herein by
reference.
2. Based on the facts included in the above recitals, set up of a
temporary chiller by an outside contractor and delivery and installation of a new
chiller to be performed by an outside contractor and necessary ancillary services
are of urgent necessity for the preservation of life, health or property, thereby
allowing the dispensing of normal bidding procedures as set forth in section 136 of
the City Charter and Section 3.20.060 of the Bakersfield Municipal Code.
3. The Finance Director is authorized to dispense with bidding in
accordance with Section 3.20.060 of the Bakersfield Municipal Code.
4. The expenditure of funds for said work, supplies, equipment or materials
shall not exceed one -hundred sixty six and five hundred dollars ($166,500).
