HomeMy WebLinkAboutRES NO 014-2021RESOLUTION NO. ® 2 02 1 A RESOLUTION OF THE BAKERSFIELD CITY COUNCIL TO UPHOLD THE APPEAL AND DENY CONDITIONAL USE PERMIT NO. 20- 0179 TO ALLOW FOR A ROOMINGHOUSE (17.10.25) IN THE R-1 (ONE -FAMILY DWELLING ZONE) DISTRICT, LOCATED AT THE 1421 PANORAMA DRIVE (WARD 3; CUP NO. 20-0179). WHEREAS, Casa Esperanza Transitional Home for Women and Children (applicant) filed an application with the City of Bakersfield Development Services Department for a conditional use permit to allow a roominghouse (B.M.C. Section 17.10.025) in the R-1 (One - Family Dwelling Zone) district, located at 1421 Panorama Drive (the "Project"); and WHEREAS, the roominghouse would utilize a single-family residence to accommodate six clients (women) and their minor children, and one on-site resident in a specific program established by the applicant; and WHEREAS, the Planning Commission held a public hearing on November 5, 2020 approving the Project (Resolution No. 55-20); and WHEREAS, Kristen and Johnny Urquidez filed an appeal with the City Clerk on November 10, 2020 of the Planning Commission's decision to approve the Project; and WHEREAS, the Clerk of the City Council set Wednesday, January 20, 2021, at 5:15 p.m. in the Council Chambers of City Hall, 1501 Truxtun Avenue, Bakersfield, California, as the time and place for a public hearing before the City Council to consider the appeal to the Planning Commission decision of November 5, 2020; and WHEREAS, the City Council considered all facts, testimony, and evidence concerning the Project, including the staff report and the Planning Commission's deliberation and action. NOW, THEREFORE, BE IT RESOLVED by the Bakersfield City Council as follows: 1. The above recitals are true and correct and incorporated herein. 2. The Council finds that the roominghouse has a specific, adverse impact upon the public health and safety due to inadequate staffing and funding for the project, and as evident in the substantial evidence submitted by over one hundred residents in the immediate area, and based upon the preponderance of evidence on the record, the Council finds that the roominghouse is not essential or desirable 'to the public convenience and welfare. 3. The Council finds that the roominghouse is unable to be conditioned at a lower density due to the financial infeasibility of the project with reduced clientele; therefore, based on the preponderance of evidence on the record, there is no feasible method to satisfactorily mitigate or avoid the adverse impact caused by the roominghouse. 4. The Council finds that based on the preponderance of the evidence on the record, the roominghouse as proposed is not in harmony with the various elements and objectives of the Metropolitan Bakersfield General Plan. .vpr�F9 � m r c7 b ORIGAAL 5.
