AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AMENDING SECTION 15.48.010,
REPEALING SECTION 15.48.020, RENUMBERING
SECTION 15.48.030 TO 15.48.020 AND AMENDING
SUBSECTION B. THEREOF, OF THE BAKERSFIELD
MUNICIPAL CODE RELATING TO THE FENCING OF
SWIMMING POOLS, SPAS, PRIVATE PONDS AND
LAKES, CANALS AND DITCHES.
BE IT ORDAINED by the Council of the City of Bakersfield
as follows:
SECTION 1.
Section 15.48.010 of the Bakersfield Municipal Code is
hereby amended to read as follows:
15.48.010
Protective enclosures for swimming pools,
spas, and hot tubs.
A. Every person who owns or is in possession of any pre-
mises on which there is situated a swimming pool, spa, or hot tub,
any of which has a water depth of eighteen inches or more in any
portion thereof, shall maintain on the lot or premises upon which
the swimming pool, spa, or hot tub is located and completely
surrounding the body of water, lot, or premises, a fence, wall, or
other adequate structure to make the water inaccessible to small
children.
B. The fence, wall, or other structure must be not less
than four and one-half feet in height and contain no openings
large enough to admit a child except through doors or gates as
provided in Section 15.48.020.
C. For purposes of this chapter, a fence around a yard
or private development containing the swimming pool, spa, or hot
tub shall be sufficient if the fencing meets the requirements of
subsection B of this section.
SECTION 2.
Section 15.48.020 of the Bakersfield Municipal Code is
hereby repealed.
SECTION 3.
Section 15.48.030 of the Bakersfield Municipal Code is
hereby renumbered as 15.48.020 and Subsection B. thereof is
amended to read as follows:
15.48.020
Doors or Gates.
B. In lieu of such self-closing or self-latching
devices, the doors and gates on fences, walls or other structures
surrounding swimming pools, spas, or hot tubs may be equipped
with locks which shall be kept locked at all times when the
swimming pools, spas, or hot tubs are not in actual use or when
authorized personnel of the owner are not present.
SECTION 4.
This ordinance shall be posted in accordance with the
City Charter provisions and shall become effective thirty (30)
days from and after the date of its passage.
