A RESOLUTION DECLARING INTENTION TO
ESTABLISH THE EASTSIDE CANAL CROSSINGS
PLANNED MAJOR THOROUGHFARE AREA AND
PRELIMINARILY APPROVING THE BOUNDARIES OF
THE AREA AND THE COST AND FEE SCHEDULE.
(WARD 1)
WHEREAS, Chapter 16.32.060.F of Title 16 of the Bakersfield Municipal
Code and Section 66484 of the California Government Code, provides for a procedure by
which the City Council may assess and collect fees for the purpose of defraying the cost of
constructing bridge crossings or major thoroughfares identified in the transportation
circulation element of the Metropolitan Bakersfield 2010 General Plan, and;
WHEREAS, Redbank Road and East Wilson Road are designated as
collectors and Muller Road is designated as an arterial road on the Circulation Element of
the Bakersfield General Plan, and;
WHEREAS, improved crossings of the above mentioned roads over the
Eastside Canal will provide a much needed connection for the east -to -west, west -to -east
traveling public, and;
WHEREAS, the developers of Vesting Tentative Maps 6892, 6939, and 6902
within ZC 05-1783, Ordinance 4380, and Vesting Tentative Maps 7152 and 715.3 within ZC
07-1193, Ordinance 4482, were conditioned for paying for their proportionate share of the
cost and shall aid in the establishment of a Planned Major Thoroughfare Area for these
above mentioned roads and bridges over the Eastside Canal to fund such improvements,
and;
WHEREAS, other properties proposed to be developed have been identified
in the adjacent land areas within the City and land areas within Kern County, outside the
City limits, as benefitting from these improved crossings, and;
WHEREAS, property located outside of the current City limits that is within
the area of benefit will only be subject to the established fee at building permit issuance
upon annexation to the City, and;
WHEREAS, property currently located in Kern County jurisdictional area and
within the area of benefit are not subject to the fees associated with the Planned Major
Thoroughfare area, unless and until such properties are annexed into the City; however,
these properties may be assessed fees by Kern County through alternative funding
methods, such as an adjusted Traffic Impact Fee, to pay for improvements of such canal
crossings, and;

WHEREAS, the City has notified all affected property owners and is
proposing the formation of the Eastside Canal Crossings Planned Major Thoroughfare
Area to reimburse the cost of the improvements upon subdivision or development of
property within the Area.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Bakersfield as follows:
1. The foregoing recitals are true and correct and are incorporated herein.
2. The Council hereby preliminarily approves the estimate, attached hereto
as Exhibit A, the fee schedule attached hereto as Exhibit B, the limits of improvements as
shown on Exhibit C and the boundary as described on the map attached hereto as Exhibit
D, for the Eastside Canal Crossings Planned Major Thoroughfare Area. Subdivision or
development of property within such Area will require payment of fees per the attached
schedule.
3. The City Council hereby fixes Wednesday, March 17, 2021, at 5:30
PM, or as soon as thereafter as may be heard, at the Council Chambers of the City
Council, 1501 Truxtun Avenue, Bakersfield, California, as the time and place for hearing
protests on the following matters:
