COVENANT REQUIRING ANNEXATION
THIS COVENANT is executed on this 21 day of July , 1998 by
Robert E. Beasley hereinafter
"Owner/s") in connection with the extension of water service to the here -in described property, located in an
unincorporated area of the County of Kern.
The real property herein described has been granted water service by the City of Bakersfield, even though the
property is not located within the incorporated boundaries of the City. As a condition of extension of said
water service to this property, the property shall be annexed into the City of Bakersfield as soon as it may be
included in an annexation which is contiguous to City boundaries. The property owners hereby waive their
right to protest such annexation and shall take all necessary steps to immediately annex into the City the
property served by City water once said property is contiguous to City boundaries. The City reserves the right
to discontinue water service if the property does not annex into the City.
This covenant may not be amended or modified without the prior approval of the City of Bakersfield. This
covenant shall run with the land.

PARCEL 1: That portion of the northeast quarter of the northwest quarter of section 28, Township
29 South, Range 27 East, Mount Diablo meridian, in the county of Kern, state of California,
according to the official plat of the survey of said land approved by the Surveyor General February
28, 1855, described as follows:
Beginning at the northwest corner of the northeast quarter of the northwest quarter of said section;
thence easterly along the northerly line of said section 37 feet; thence south 16 degrees 20 minutes
East, 253.3 feet; thence South 1 degree 08 minutes west, 228.6 feet; thence South 23 degrees 38
minutes west, 265 feet, to a point in the west line of the northeast quarter of the northwest quarter;
thence north along the westerly line of the northeast quarter of the northwest quarter to the point of
beginning.
EXCEPT that portion thereof described as follows:
Beginning at the northwest corner of the northeast quarter of the northwest quarter of said section
28; thence South 22 degrees 21 minutes East, 3.83 chains; thence South 3 degrees 11 minutes west

West, 265 feet; thence South 00 degrees 10 minutes west, 607.15 feet; thence South 89 degrees 47
minutes East, 371 feet; thence North 00 degrees 10 minutes East, 1321.65 feet; thence North 89
degrees 47 minutes west, 334 feet to the point of beginning.
