COVENANT REQUIRING ANNEXATION
THIS COVENANT is executed on this .,**Irl day of NoyEM4FA. , 2000, by Ralph and Dorothy Palla
(hereinafter "Owner") in connection with the extension of a water service pipeline the here -in described
property, located in an unincorporated area of the County of Kern.
WHEREAS, Owner has agreed to pay a portion of the costs to provide a City domestic water
pipeline across State Route 58 at Henry Lane, in the County of Kern, State of California; and
WHEREAS, this pipeline will allow the Owner to have domestic water service to their property in
order to have proper drinking water and fire protection service; and
WHEREAS, Owner's land, described below, is not within the corporate boundaries of the City of
Bakersfield; and
NOW, THEREFORE, incorporating the foregoing recitals herein, Owner agrees as follows:
As a condition of extension of said water service to Owner's property, Owner shall initiate annexation
proceedings as soon as the Owner's property becomes contiguous to City boundaries. Owners hereby
waive their right to protest such annexation and shall take all necessary steps to immediately annex into
the City the property shown on the attached Exhibit "A" and described herein. The City reserves the right
to discontinue water service to Owner's property if the property does not annex into the City.
This covenant may not be amended or modified without the prior approval of the City of Bakersfield. This
covenant shall run with the land.
Property description: 2610 Henry Lane; County of Kern Assessor's Parcel No. 452-060-22-00, being a
portion of the SW1I4 Section 21 T.29S. R.27E.
NOTE: All signatures must be notarized.
