1 , by ANTONIO T. AVILA, hereinafter "Owner", in
connection with the extension of sewer service to the herein -described property, located in an unincorporated area of the
County of Kern.
The real property herein -described has been granted sewer service by the City of Bakersfield, even though the property is not
located within the City. As a condition of extension of said sewer service to this property, the property shall be annexed into
the City of Bakersfield as soon as it may be included in an annexation which is contiguous to City boundaries. The right to
protest such annexation is hereby waived.
This covenant may not be amended or modified without the prior approval of the City of Bakersfield. This covenant shall
run with the land.

WHEREAS, the City of Bakersfield, a Municipal Corporation, hereinafter referred to as "Licensor,"
is the owner of the "'Bakersfield Sewerage Syrsteni" and as stall owner is responsible for the collection and
disposal of all sewage within the City: and
WHEREAS, the Licensee is desirous of connecting a private sewer to the system in accordance with
the provisions of the Bakersfield Municipal ("ode and amendments thereto, on property located at the above
named service address, which. property is outside the corporate limits of the Licensor.
NOW, THEREFORE, the Licensor, in consideration of the payment of bi-monthly rates and charges
determined and set by the City Council, as such rates :ind charges may be adjusted from time to time, and
subject to and in consideration of the faithful performance by Licensee of all the ternis and conditions of this
Agreement. hereby permits Licensee to construct, reconstruct, maintain, operate, and connect a private sewer
for conveying sewage from the property of Licensee, as above set forth.
This Agreement replaces and supersedes any agreement previously made between the parties
pertaining to sewer coiinc;ction on or from the above: property.
Fogy- each new agreement issued. Licensee agrees to pay an administrative charge of Ten Dollars
(S 10.00) to offset the administrative costs of establishing and servicing the account.
Thr terrns and conditions printed on tale reverse side of this Agreement are specifically incorporated
herein, and l.ice°nsee by ;ignattire below acknowledges having read, and hereby accepts, such terms and
conditions.
