Public Participation and Accessibility
February 17, 2021 Bakersfield City Council Meetings
On March 18, 2020, Governor Gavin Newsom issued Executive Order N-29-20,
which includes a waiver of Brown Act provisions requiring physical presence of
the Council or the public in light of the COVID-19 pandemic.
Based on guidance from the California Governor's Office and Department of
Public Health, as well as the County Health Officer, in order to minimize the
potential spread of the COVID-19 virus, the City of Bakersfield hereby provides
notice that as a result of the declared federal, state, and local health
emergencies, and in light of the Governor's order, the following adjustments
have been made:
1. The meeting scheduled for February 17, 2021, at 3:30 p.m. will have
limited public access.
2. The meeting scheduled for February 17, 2021, at 5:15 p.m. will have
limited public access.
3. Consistent with the Executive Order, Councilmembers may elect to
attend the meeting telephonically and to participate in the meeting to
the same extent as if they were physically present.
4. The public may participate in each meeting and address the City Council
as follows:

a. Quarterly Homeless Update Part 1: Presentation by Executive
Director of Mercy House on progress at the Brundage Lane
Navigation Center.
(Staff recommends the Council receive and file presentation.)
Assistant City Manager Kitchen made staff comments.
Larry Haynes, Executive Director of Mercy House, made comments
and provided a PowerPoint presentation.
Theo Dues, Program Manager for Brundage Lane Navigation
Center, made additional comments.
Councilmember Gonzales requested staff pursue the idea of
recuperative beds at the Brundage Lane Navigation Center.
Motion by Vice -Mayor Weir to receive and file the presentation.
Motion passed with Councilmember Freeman absent.

Regional Homeless Collaborative Executive Director.
(Staff recommends the Council to receive and file presentation.)
Anna Laven, Deborah Johnson, and Heather Kimmel, Bakersfield
Kern Regional Homeless Collaborative, made comments and
provided a PowerPoint presentation.
Councilmember Gonzales requested staff explore developing a
discretionary fund for use by the BLNC for services such as tow
trucks for client vehicles, transporting clients to family, and similar
scenarios.
Motion by Vice -Mayor Weir to receive and file the presentation.
Motion passed with Councilmember Freeman absent.
4. CLOSED SESSION
a. Conference with Legal Counsel — Existing Litigation; Closed Session
pursuant to Government Code section 54956.9(d) (1) regarding
Kylie Deckard v. City of Bakersfield, et al., Kern County Superior
Court Case No. BCV -19-101657
Motion by Vice -Mayor Weir to adjourn to Closed Session at
4:33 p.m. Motion passed with Councilmember Freeman absent.
The Closed Session meeting was adjourned at 4:50 p.m.
Meeting reconvened at 4:56 p.m.
5. CLOSED SESSION ACTION
a. Conference with Legal Counsel — Existing Litigation; Closed Session
pursuant to Government Code section 54956.9(d) (1) regarding

4. PRESENTATIONS
a. Proclamation to the Safely Surrendered Baby Coalition declaring
Safe Surrender Baby Awareness Month in Bakersfield during
February 2021.
Jana Slagle, Chair of the Safely Surrendered Baby Coalition, and
Roland Maier, Executive Director of First 5 Kern, accepted the
Proclamation and made comments.
5. PUBLIC STATEMENTS
a. Troy Hightower requested a status update on the street light study.
Mayor Goh requested that staff follow up with Mr. Hightower
regarding the street light study.
b. Michael Harless spoke in support of the continuation of night
services from Golden Empire Transit; and stated the bus stop at
Brundage Lane and Union Avenue is in need of repair.
C. G.N.M. emailed comments expressing concern with the City's
efforts protecting victims and the confidentiality of addresses on
the City's website.
d. Rich O'Neil emailed comments regarding a request to use Measure
N funding for a feasibility study on Kern River Parkway
improvements, maintenance, and enhancements.
e. Johanna Coronado emailed comments expressing concern with
public noticing of Public Safety and Vital Services Committee
meetings.

City Manager Clegg made staff comments.
Amy Thelen, Bitwise Industries, made comments and provided a
PowerPoint presentation.
Ryan Alsop, Kern County Chief Administrator, made additional
comments.
Motion by Vice -Mayor Weir to receive and file the presentation.

CONSENT CALENDAR
Staff recommends adoption of Consent Calendar items.

a. Approval of minutes of the February 3, 2021, Regular City
Council Meetings.
Payments:
b. Receive and file department payments from January 22, 2021, to
February 4, 2021, in the amount of $15,028,887.80; Self Insurance
payments from January 22, 2021, to February 4, 2021, in the amount
of $397,269.46; totaling $15,426,157.26.

C. Resolution approving an application to the Kern County Local
Agency Formation Commission to annex inhabited territory into the
City identified as Annexation No. 705 (Panama No. 26) located on
the southwest and southeast corners of the Panama Lane and
Progress Road intersection. Use of a Notice of Exemption will also
be considered.

d. Resolution determining that Holmatro rescue equipment is the
Bakersfield Fire Department standard and it cannot be reasonably
obtained through the usual bidding procedures and authorizing

1. Resolution determining that a wheel loader with a waste
handler package can most efficiently be obtained through
cooperative procurement bidding procedures from
Coastline Equipment Company and authorizing the Finance
Director to dispense with bidding thereof, not to exceed
$350,000.

Works Operating Budget to fund the purchase cost for a

Public Safety/Vital Services Measure:
U. Contract Change Order No. 1 to Agreement No. 2020-265 with
California Air Systems, Inc. ($2,000; revised not to exceed $42,500),
for the installation of kitchen hood system components at the
Brundage Lane Navigation Center.

A staff memorandum was received regarding item 8.a., transmitting

Councilmember Gonzales requested item 8.j. be removed for separate
consideration.
Motion by Vice -Mayor Weir to adopt Consent Calendar items 8.a. through
8.v., with the removal of item 8.j. for separate consideration. Motion
passed.

HEARINGS
a. Public Hearing to consider General Plan Amendment/Zone
Change No. 19-0405. McIntosh & Associates, representing
Price Environmental Services, LLC (property owner), is proposing a
General Plan Amendment/Zone Change located on the northwest
corner of the South Union Avenue and Astor Avenue intersection.
The request includes: (1) an amendment to the Metropolitan
Bakersfield General Plan Land Use Element designation from LR
(Low Density Residential) and SR/LR (Suburban Residential/Low
Density Residential) to SI (Service Industrial) on 2.64 acres; and (2) a
change in zone classification from R -S-1 A (Residential Suburban 1
Acre Minimum) to M-1 (Light Manufacturing) or a more restrictive
zone classification on 2.64 acres (1.45 acres in the City limits and
1.19 outside the limits to be prezoned M-1). Negative Declaration

13. NEW BUSINESS
a. Solid Waste Division Recycling Program Update.
(Staff recommends Council authorizing staff to submit a leiter of interest to BARC to
purchase their recycling facility and negotiate a sale price.)
City Manager Clegg made staff comments.
Public Works Director Fidler made additional staff comments and
provided a PowerPoint presentation.
Councilmember Parlier requested staff look into advocating on
behalf of the refuse haulers to reduce tipping fee costs.
Motion by Councilmember Gray to not send a letter of interest at
this time, that staff will continue to research various options
available to the City, include BARC and refuse haulers in the study
and discussion; and return to the City Council with multiple options,
including pros and cons of each. Motion failed with
Councilmembers Arias, Gonzales, Smith, Freeman, and
Parlier voting no.
Motion by Councilmember Smith to approve the staff
recommendation. Motion passed with Vice -Mayor Weir and
Councilmember Gray voting no.
Mayor Goh recessed the meeting at 7:13 p.m. and reconvened the meeting at
7:21 p.m.
b. Fiscal Year 2020-21 Mid -Year Budget Update
(Staff recommends the City Council approve the mid -year appropriations as
outlined in Exhibit "A" attached to this staff report.)
Assistant City Clerk Legge announced a staff memorandum
transmitting correspondence was received regarding item 13.b.
City Manager Clegg made staff comments.
Assistant City Manager Huot and Finance Director McKeegan
made staff comments and provided a PowerPoint presentation.
Councilmember Freeman requested the long range financial
plan include scenarios for low, medium, and high revenue growth
projection rates; and requested this information be compared with
other cities.
Vice -Mayor Weir requested additional security services to
expand beyond the downtown area into other wards.
Vice -Mayor Weir requested staff address the tumbleweed and
landscaping issues along Highway 178.

Councilmember Parlier requested additional security services for
Ward 7, specifically the Auto Mall area.
The following individuals expressed concern regarding the fiscal
update and proposed allocations: Eddy Laine, Sierra Club
(submitted written material); Mike Turnipseed, Kern County
Taxpayers Association; and Riddhi Patel.
Councilmember Parlier and Councilmember Gray left the meeting at this
time.
Mayor Goh recessed the meeting at 8:38 p.m. and reconvened the
meeting at 8:40 p.m.
Councilmember Arias requested staff review the needs for parks
beyond existing playground equipment and discuss improvements
such as lighting and maintenance.
Councilmember Arias requested that the ward -specific CIP
account amounts for Wards 1 and 2 be expanded, and considered
for additional wards.
Councilmember Parlier and Councilmember Gray returned to the
meeting at this time.
Councilmember Gonzales requested staff also look into
enhancements for parks, not just deferred maintenance.
Councilmember Gonzales requested that staff present, during the
budget process, a 10 -year summary of spending for all respective
wards and on what the City has done to invest in all parks.
Motion by Vice -Mayor Weir to approve the staff recommendation.
Motion passed.
14. COUNCIL AND MAYOR STATEMENTS
Councilmember Parlier requested a clean-up of cardboard dumped
at the southwest corner of Wible Road and Hosking Road, and the graffiti
on the sump fence, at the northwest corner of Wible Road and Loyalton
Avenue.
Councilmember Arias requested staff reach out to Sally Westlake, from
California State Insurance Commissioner Ricardo Lara's office, to provide
a presentation to the Council on how the City can partner with them to
keep the streets safe.
Councilmember Weir requested that the issue of the required 10 -year
redistricting process be brought to the Legislation & Litigation Committee,
and asked staff to provide the committee with the criteria, process, steps,
timeline, and resources necessary to carry out this process.
