February 3, 2021 Bakersfield City Council Meetings
On March 18, 2020, Governor Gavin Newsom issued Executive Order N-29-20,
which includes a waiver of Brown Act provisions requiring physical presence of
the Council or the public in light of the COVID-19 pandemic.
Based on guidance from the California Governor's Office and Department of
Public Health, as well as the County Health Officer, in order to minimize the
potential spread of the COVID-19 virus, the City of Bakersfield hereby provides
notice that as a result of the declared federal, state, and local health
emergencies, and in light of the Governor's order, the following adjustments
have been made:
1. The meeting scheduled for February 3, 2021, at 3:30 p.m. will have
limited public access.
2. The meeting scheduled for February 3, 2021, at 5:15 p.m. will have
limited public access.
3. Consistent with the Executive Order, Councilmembers may elect to
attend the meeting telephonically and to participate in the meeting to
the same extent as if they were physically present.
4. The public may participate in each meeting and address the City Council
as follows:

a. Yolanda Hamen expressed concern with the Golden Empire Transit
District schedule and submitted written material.
Councilmember Arias requested staff reach out to GET bus to
provide a presentation to the Council.

a. Downtown Master Sewer Study Presentation by MKN & Associates.
(Staff recommends the City Council receive and file the Downtown Master Sewer
Study.)
City Clerk Drimakis announced a staff memorandum was received
regarding item 3.a., transmitting correspondence.
Public Works Director Fidler made staff comments.
Josh Nord and Rob Lepore, MKN & Associates, Inc., made
comments and provided a PowerPoint presentation.
Motion by Vice -Mayor Weir to receive and file. Motion passed.

Motion by Vice -Mayor Weir to adjourn to Closed Session at
4:04 p.m. Motion passed.
The Closed Session meeting was adjourned at 4:36 p.m.

City Clerk Drimakis announced a staff memorandum was received regarding
Hearing item I O.a., advising that staff will conduct the public hearing to receive
public comment but no action will be taken tonight.
5. PUBLIC STATEMENTS
a. Michael Turnipseed, Kern County Taxpayers Association, expressed
concern with police staffing, crime rates, and customer safety; and
submitted written material.
Councilmember Parlier requested that the following topics be
discussed with the Safe Neighborhoods Committee: Police staffing
levels/lateral hiring efforts; crime statistics/rates; and accounting for
sworn personnel between General Fund and PSVS.
Councilmember Freeman requested that the topics referred to the
Safe Neighborhood Committee by Councilmember Parlier also be
brought back for presentation to the full City Council.
Councilmember Parlier requested that staff present a workshop on
crime levels to the City Council.
b. James Osborne, Vice -President of Villagers Inc., spoke regarding his
non-profit organization that offers free distance learning services in
Bakersfield; and asked Council for support to help with the rising
need for their services.
Councilmember Gonzales requested staff contact Mr. Osborne,
and explore potential resource assistance options such as CDBG
project allocations or CARES funding.

Public Safety/Vital Services Measure:
City Clerk Drimakis announced a staff memorandum was received
regarding item 8.w., transmitting additional reports.
Councilmember Smith requested item 81 be removed for separate
consideration.
Motion by Vice -Mayor Weir to adopt Consent Calendar items 8.a. through
8.x., with the removal of item 81 for separate consideration. Motion
passed.
f. Rescission of the following Ordinances:
1. Rescission of Ordinance No. 5023 amending Section 6.08 of
the Bakersfield Municipal Code relating to Fowl and
Rescission of Ordinance No. 5032 which created Chapter
6.09 Relating to Hens in the R-1 Zone.
2. Rescission of Ordinances (Clean-ups) amending the
Bakersfield Municipal Code as follows:
• Ordinance No. 5024: Section 6.04.230 of the
Bakersfield Municipal Code relating to Keeping of
Noisy Animals.
• Ordinance No. 5025: Section 6.20.010 of the
Bakersfield Municipal Code relating to Maiming,

Motion by Councilmember Smith to uphold the existing ordinances and
continue to fight the current lawsuit.
Motion by Vice -Mayor Weir to approve item 8.f, and that the subject of
backyard hens not appear in front of the Council until a vote by four
Councilmembers to discuss the issue. Motion passed with
Councilmembers Arias, Gonzales, and Smith voting no.
Councilmember Arias requested staff establish a standard or criteria for
whether or not the City should defend an ordinance against litigation in
the future.
9. CONSENT CALENDAR PUBLIC HEARINGS
(Staff recommends conducting Consent Calendar Public Hearing and approving staff
recommendations.)

10. HEARINGS
a. Public Hearing to consider a resolution ordering the vacation of
portions of several streets in the Westpark neighborhood that are
now rendered inoperable by the construction of the Centennial
Corridor freeway.
(Staff recommends approval of the resolution.)

regarding item 10.a., advising that staff will conduct the public
hearing to receive public comment, but no action will be taken
tonight.
Councilmember Parlier left the meeting at 6:14 p.m. and returned to the
meeting at 6:16 p.m.
Mayor Goh announced this hearing will be opened and closed,
and will be noticed for a future date.

14. COUNCIL AND MAYOR STATEMENTS
Councilmember Parlier requested the Safe Neighborhoods Committee
obtain information on a drone program, citing the Chula Vista program as
an example, for purposes of patrol and stopping crimes in progress.
Councilmember Gray commended staff for their quick response to
address a homeless camp near Pacheco and Stine Road; and for their
efforts with street racing issues.
Councilmember Gonzales stated that he visited the Brundage Lane
Navigation Center (BLNC) today and learned there were 115 guests at
the shelter; out of the 14 weeks the facility has been open, there have
been 14 guests that have entered permanent housing; and expressed
appreciation to staff for the new kitchen.
Councilmember Arias requested staff explore the possibility of purchasing
or transferring the County -owned veterans building next to MLK park to the
City.
Councilmember Arias requested staff restart the discussion for building
out some "clean street teams" through the Bakersfield Homeless Center.
