HomeMy WebLinkAboutRES NO 052-2021RESOLUTION NO. 052 —2 02 1 RESOLUTION OF THE CITY OF BAKERSFIELD ADOPTING THE EASTSIDE CANAL CROSSINGS PLANNED MAJOR THOROUGHFARE AREA AND MAKING FINDINGS RELATIVE THERETO. (WARD 1) X-Refo WHEREAS, by Resolution of Intention No. 2077, adopted February 17, 2021, a public hearing was called for March 17, 2021, at the hour of 5:15 pm in the Council chambers in the City Hall, 1501 Truxtun Avenue, Bakersfield, California, regarding the establishment of the Eastside Canal Crossings Planned Major Thoroughfare Area; and. WHEREAS, notice of such hearing has been given to all affected property owners as such are shown on the latest equalized assessment roll; and, WHEREAS, such hearing has been duly and regularly held, and all persons interested have been given an opportunity to appear and be heard. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The foregoing recitals are true and correct and incorporated herein by reference. 2. The facilities in the Eastside Canal Crossings Planned Major Thoroughfare Area are located on roads identified in the circulation element of the 2010 General Plan. 3. The Eastside Canal Crossings Planned Major Thoroughfare Area is in addition to existing major thoroughfares serving the area. 4. No majority protest as to the formation of the Eastside Canal Crossings Planned Major Thoroughfare Area exists. 5. The Council hereby finds that, as to the Eastside Canal Crossings Planned Major Thoroughfare Area, as described in the plans and maps attached hereto and incorporated herein by reference, subdivision and development of property within each such area will require construction of facilities, described in each such area either on the basis of benefits conferred on property for subdivision or on the need for such facilities created by the proposed subdivision and development of other property within such area, and that the fees provided within the schedule attached, are fairly apportioned. 6. Improvements include widening of canal crossing at Redbank Road, construction of canal crossing at E Wilson Road and widening of canal crossing at Muller Road. The individual improvements are described below. The Cost of the improvements are divided into 3 sub -districts each, encompasses a one square mile area centered at each crossing. Only undeveloped parcels are included in the District. The total acreage of each parcel is included, even if only a part of the parcel is in the 1 mile service area. Due to the proximity of the crossings there is an overlap of the districts. In an attempt at fairness in the distribution of the cost, these sub -districts are divided into 2 north and south sub -districts each. The parcels included in each district and sub -districts are shown in Figure 1 and in Table 1 and Tablet below.
