TheCaliforniaGeologicEnergyManagementDivision(CalGEM)hasreceivedandreviewedtheabove referencedprojectdated3/25/2021.Toassistlocalpermittingagencies,propertyowners,and developersinmakingwiselandusedecisionsregardingpotentialdevelopmentnearoil,gas,or geothermalwells,theDivisionprovidesthefollowingwellevaluation. TheprojectislocatedinKernCounty,withintheboundariesofthefollowingfields: CanfieldRanch Ourrecordsindicatethereare2knownoilorgaswellslocatedwithintheprojectboundaryas identifiedintheapplication. ¨NumberofwellsNotAbandonedtoCurrentDivisionRequirementsasPrescribedbyLawand ProjectedtoBeBuiltOverorHaveFutureAccessImpededbythisproject:1 ¨NumberofwellsNotAbandonedtoCurrentDivisionRequirementsasPrescribedbyLawand NotProjectedtoBeBuiltOverorHaveFutureAccessImpededbythisproject:0 ¨NumberofwellsAbandonedtoCurrentDivisionRequirementsasPrescribedbyLawand ProjectedtoBeBuiltOverorHaveFutureAccessImpededbythisproject:1 ¨NumberofwellsAbandonedtoCurrentDivisionRequirementsasPrescribedbyLawand NotProjectedtoBeBuiltOverorHaveFutureAccessImpededbythisproject:0 TheDivisioncategoricallyadvicesagainstbuildingover,orinanywayimpedingaccessto,oil,gas,or Page 1 Page 1Page 1Page 1 Page 2 geothermalwells.Impedingaccesstoawellcouldresultintheneedtoremoveanystructureor obstaclethatpreventsorimpedesaccessincluding,butnotlimitedto,buildings,housing,fencing, landscaping,trees,pools,patios,sidewalks,roadways,anddecking.Maintainingsufficientaccessis consideredtheabilityforawellservicingunitandassociatednecessaryequipmenttoreachawell fromapublicstreetoraccessway,solelyovertheparcelonwhichthewellislocated.Awellservicing unit,andanynecessaryequipment,shouldbeabletopassunimpededalongandovertheroute,and shouldbeabletoaccessthewellwithoutdisturbingtheintegrityofsurroundinginfrastructure. TherearenoguaranteesawellabandonedincompliancewithcurrentDivisionrequirementsas prescribedbylawwillnotstartleakinginthefuture.Italwaysremainsapossibilitythatanywellmay starttoleakoil,gas,and/orwaterafterabandonment,nomatterhowthoroughlythewellwasplugged andabandoned.TheDivisionacknowledgeswellspluggedandabandonedtothemostcurrent Divisionrequirementsasprescribedbylawhavealowerprobabilityofleakinginthefuture,however thereisnoguaranteesthatsuchabandonmentswillnotleak. TheDivisionadvisesthatallwellsidentifiedonthedevelopmentparcelpriorto,orduring, developmentactivitiesbetestedforliquidandgasleakage.Surveyedlocationsshouldbeprovidedto theDivisioninLatitudeandLongitude,NAD83decimalformat.TheDivisionexpectsanywellsfound leakingtobereportedtoitimmediately. Failuretoplugandreabandonthewellmayresultinenforcementaction,includinganordertoperform reabandonmentwellwork,pursuanttoPRC§3208.1,and3224. PRC§3208.1givetheDivisiontheauthoritytoorderorpermitthere-abandonmentofanywellwhere ithasreasontoquestiontheintegrityofthepreviousabandonment,orifthewellisnotaccessibleor visible.Responsibilityforre-abandonmentcostsmaybeaffectedbythechoicesmadebythelocal permittingagency,propertyowner,and/ordeveloperinconsideringthegeneraladvicesetforthinthis letter.ThePRCcontinuestodefinethepersonorentityresponsibleforreabandonmentas: 1.Thepropertyowner-IfthewellwaspluggedandabandonedinconformancewithDivision requirementsatthetimeofabandonment,andinitscurrentconditiondoesnotposean immediatedangertolife,health,andproperty,butrequiresadditionalworksolelybecausethe ownerofthepropertyonwhichthewellislocatedproposesconstructiononthepropertythat wouldpreventorimpedeaccesstothewellforpurposesofremedyingacurrentlyperceived futureproblem,thentheownerofthepropertyonwhichthewellislocatedshallobtainall rightsnecessarytoreabandonthewellandberesponsibleforthereabandonment. 2.Thepersonorentitycausingconstructionoverornearthewell-Ifthewellwas pluggedandabandonedinconformancewithDivisionrequirementsatthetimeofplugging andabandonment,andthepropertyowner,developer,orlocalagencypermittingthe constructionfailedeithertoobtainanopinionfromthesupervisorordistrictdeputyasto whetherthepreviouslyabandonedwellisrequiredtobereabandoned,ortofollowthe Page 2 Page 1Page 1Page 1 Page 3 adviceofthesupervisorordistrictdeputynottoundertaketheconstruction,thentheperson orentitycausingtheconstructionoverornearthewellshallobtainallrightsnecessary toreabandonthewellandberesponsibleforthereabandonment. 3.Thepartyorpartiesresponsiblefordisturbingtheintegrityoftheabandonment-Ifthewell waspluggedandabandonedinconformancewithDivisionrequirementsatthetimeof pluggingandabandonment,andafterthattimesomeoneotherthantheoperatororan affiliateoftheoperatordisturbedtheintegrityoftheabandonmentinthecourseofdeveloping theproperty,thenthepartyorpartiesresponsiblefordisturbingtheintegrityofthe abandonmentshallberesponsibleforthereabandonment. Nowellworkmaybeperformedonanyoil,gas,orgeothermalwellwithoutwrittenapprovalfromthe Division.Wellworkrequiringapprovalincludes,butisnotlimitedto,mitigatingleakinggasorother fluidsfromabandonedwells,modificationstowellcasings,and/oranyotherre-abandonmentwork. TheDivisionalsoregulatesthetopofapluggedandabandonedwell'sminimumandmaximumdepth belowfinalgrade.CCR§1723.5stateswellcasingsshallbecutoffatleast5feetbutnomorethan10 feetbelowgrade.Ifanywellneedstobeloweredorraised(i.e.casingcutdownorcasingriseradded) tomeetthisregulation,apermitfromtheDivisionisrequiredbeforeworkcanstart. TheDivisionmakesthefollowingadditionalrecommendationstothelocalpermittingagency,property owner,anddeveloper: 1.Toensurethatpresentandfuturepropertyownersareawareof(a)theexistenceofallwells locatedontheproperty,and(b)potentiallysignificantissuesassociatedwithany improvementsnearoilorgaswells,theDivisionrecommendsthatinformationregardingthe aboveidentifiedwell(s),andanyotherpertinentinformationobtainedaftertheissuanceof thisletter,becommunicatedtotheappropriatecountyrecorderforinclusioninthetitle informationofthesubjectrealproperty. 2.TheDivisionrecommendsthatanysoilcontaininghydrocarbonsbedisposedofin accordancewithlocal,state,andfederallaws.Pleasenotifytheappropriateauthoritiesif soilcontainingsignificantamountsofhydrocarbonsisdiscoveredduringdevelopment. AsindicatedinPRC§3106,theDivisionhasstatutoryauthorityoverthedrilling,operation, maintenance,andabandonmentofoil,gas,andgeothermalwells,andattendantfacilities,toprevent, asfaraspossible,damagetolife,health,property,andnaturalresources;damagetoundergroundoil, gas,andgeothermaldeposits;anddamagetoundergroundandsurfacewaterssuitableforirrigation ordomesticpurposes.InadditiontotheDivision'sauthoritytoorderworkonwellspursuanttoPRC§§ 3208.1and3224,ithasauthoritytoissuecivilandcriminalpenaltiesunderPRC§§3236,3236.5,and 3359forviolationswithintheDivision'sjurisdictionalauthority.TheDivisiondoesnotregulategrading, Page 3 Page 1Page 1Page 1 Page 4 excavations,orotherlanduseissues. Ifduringdevelopmentactivities,anywellsareencounteredthatwerenotpartofthisreview,the propertyownerisexpectedtoimmediatelynotifytheDivision'sconstructionsitewellreviewengineerin theInlanddistrictoffice,andfileforDivisionreviewanamendedsiteplanwithwellcasingdiagrams. TheDistrictofficewillsendafollow-upwellevaluationlettertothepropertyownerandlocalpermitting agency.
