HomeMy WebLinkAboutORD NO 3191ORDINANCE NO. 3191 NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING SECTION 17.06.020 OF CHAPTER 17.06 (ZONING MAP) OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD REGARDING PREZONING OF PROPERTY KNOWN AS THE STOCKDALE NO. 13 ANNEXATION. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission held a public hearing on a request by the City of Bakersfield to zone certain property now being annexed to said City and made several general and specific findings of fact which warranted a negative declaration of environmental impact; and WHEREAS, there appears to be no substantial detrimental environmental impact which could result from this zoning action; and WHEREAS, the proposed zoning substantially conforms to the General Plan; and WHEREAS, the City Council has determined after due con- sideration of the motion and recommendation of the Planning Commission, herein on file, together with the reasons advanced at the Planning Commission hearing, that said zoning should be authorized upon annexation of said property to the City. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: SECTION 1. A. All the foregoing recitals are found to be true and correct. B. The Negative Declaration for this zoning action is hereby approved and adopted. C. That Section 17.06.020 of Chapter 17.06 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by extending the boundaries of said map to include that certain property in the County of Kern located at the southeast corner of Stockdale Highway and Allen Road, and con- tiguous to the boundary of the City of Bakersfield known as the STOCKDALE NO. 13 ANNEXATION, upon the annexation of said property to the City of Bakersfield, the boundaries of which property are shown on the map hereto attached and made a part of this ordinance, and are more specifically described as follows: TO AN A-20 (AGRICULTURAL TWENTY-ACRE MINIMUM LOT SIZE) ZONE: EXHIBIT "A" A parcel of land situated in the North half of Section 1, Township 30 South, Range 26 East, M.D.B. & M., County of Kern, State of California, more particularly described as follows: Beginning at a point on the West line of said Section 1 being the point of intersection with the South right of way line of Stockdale Highway (Co. Rd. No. 696) and said point also being on the existing Corporate Boundary of the City of Bakersfield; THENCE (1) North 00032'25" East, on and along the West line of the North half of said Section 1, a distance of 2.89 feet more or less to the Northwest corner of said Section; THENCE (2) South 89013'53" East, on and along the North line of said Section 1, a distance of 3,959.26 feet to the Northwest corner of the Northeast quarter of the Northeast quarter of said Section 1, also being on the existing Corporate Boundary of the City of Bakersfield; THENCE (3) South on and along the West line of the Northeast quarter of said Section, a dis- tance of 310.35 feet more or less to a point on the Northwesterly right of way line of the Cross Valley Canal; THENCE (4) Southwesterly on and along various courses of said Canal right of way to a point on the West line of the North half of said Section 1; - 2 - THENCE (5) North 00032'25" East on and along said West line, a distance of 2,101.56 feet to the point of beginning. EXCEPTING the dedicated public road right of way for Stockdale Highway. Containing 104.35 acres more or less. SECTION 2.
