Home My WebLink AboutROI NO 2084RESOLUTION OF INTENTION NO. 2084 A RESOLUTION DECLARING INTENTION TO AMEND THE BOUNDARY FOR THE PANAMA AND UNION PLANNED SEWER AREA AND PRELIMINARILY APPROVING THE AMENDED FEE SCHEDULE. WHEREAS, Chapter 16.32.060.E of Title 16 of the Bakersfield Municipal Code and Section 66483 of the California Government Code provide for a procedure by which the City Council may assess and collect fees for the purpose of defraying the cost of constructing sewer facilities for local and neighborhood sewer areas; and WHEREAS, the City of Bakersfield desires to provide sewer facilities for a developing area as shown on the map entitled "Panama and Union Planned Sewer Area Boundary", attached hereto as Exhibit "A" arid incorporated by reference; and WHEREAS, the City of Bakersfield has constructed the sanitary sewer line as shown on Exhibit "A"; and WHEREAS, the City of Bakersfield desires to recoup the cost of constructing said sewer line; and WHEREAS, the original Panama and Union Planned Sewer Area was adopted by Resolution No. 083-07 on April 25, 2007, and is currently part of Ordinance Section 16.32.060.E of the Bakersfield Municipal Code relating to Sewer Facilities; and WHEREAS, Amendment (1) of Panama and Union Planned Sewer Area was adopted by Resolution No. 083-07 (1) on November 17, 2010, and is currently part of Ordinance Section 16.32.060.E of the Bakersfield Municipal Code relating to Sewer Facilities; and WHEREAS, the annexation of additional lots to the City, which will benefit within this sewer, has brought a need to amend the Panama and Union Planned Sewer Area fee schedule and boundary; and WHEREAS, the proposed amended Planned Sewer Area fees set forth in Exhibit "B", attached hereto and incorporated by reference, do not exceed the reasonable estimated cost based to provide sewer services. The Council hereby preliminarily approves the Amended Panama and Union Planned Sewer Area boundary and fee schedule attached hereto as Exhibit "A" and Exhibit "B" respectively, as a replacement to the amended Panama and Union Sewer Area fee schedule and boundary. 3. Subdivision or development of property within such area will require payment of fees per the attached schedule.
