A RESOLUTION DECLARING INTENTION TO
ESTABLISH THE SEWER PLAN FOR THE
PANAMA AND COTTONWOOD PLANNED
SEWER AREA AND PRELIMINARILY
APPROVING THE COST AND FEE SCHEDULE
AND THE BOUNDARIES OF THE AREA.
WHEREAS, Chapter 16.32.060.E of Title 16 of the Bakersfield Municipal Code
and Section 66.483 of the California Government Code, provides for a
procedure by which the City Council may assess and collect fees for the
purpose of defraying the cost of constructing sewer facilities for local and
neighborhood sewer areas; and
WHEREAS, the City of Bakersfield desires to provide sewer facilities for a
rapidly developing area as shown on the map entitled "Panama and
Cottonwood Planned Sewer Area" attached hereto as Exhibit "A", and
incorporated by reference; and
WHEREAS, Segment 1 3125' of 10" sewer trunk line from the manhole 227'
south of the manhole at the intersection of Warwickshire Avenue and Madison
Street to the south manhole on East Panama Lane, 113' east of Crescent Lane
center line, as shown in the Sewer Area Boundary Exhibit "A"; and
WHEREAS, the Greenfield Union School District and the Kern High School
District are funding and constructing the new Segment 1 10" sewer trunk line in
full, as shown in the Fee Schedule Exhibit "Cl "; and
WHEREAS, the 49.82 acre parcel at the northwest corner of Panama Lane
and Cottonwood Road is receiving some benefit from said Segment 1, 10"
sewer trunk line extension; and
WHEREAS, Segment 2 1380' of 8" parallel sewer trunk line from the
manhole 230' east of the intersection of South Union Avenue and Berkshire Road
to the manhole 238' west of Elsinore Avenue and Berkshire Road, as shown in the
Sewer Area Boundary Exhibit "A"; and
WHEREAS, the 49.82 acre parcel at the northwest corner of Panama Lane
and Cottonwood Road to fund the new Segment 2 8" sewer trunk line in full, as
shown in the Fee Schedule Exhibit "C2"; and
WHEREAS, the City desires to recoup the cost of constructing said sewer
line for Segment 2; and

WHEREAS, the fees and charges set forth in Exhibit "B1" and Exhibit "132"
attached hereto and incorporated by reference, are based on the actual cost
of providing the services for which the fees are charged.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield
as follows:
The foregoing recitals are true and correct and are
incorporated herein.
2. The Council hereby preliminarily approves the boundary of
the "Panama and Union Planned Sewer Area" area of
benefit and limits of improvements as described on the map
attached hereto as Exhibit "A", the cost attached hereto as
Exhibit "B1" and Exhibit "112" and fee schedule attached
hereto as Exhibit "C1" and Exhibit "C2".
3. Subdivision or development of property within such area will
require payment of fees per the attached schedule.
4. The City Council hereby sets Wednesday, May 19, 2021, at
5:15PM, or as soon thereafter as may be heard, at the
Council Chambers of the City Council, 1501 Truxtun Avenue,
Bakersfield, California, as the time and place for hearing
protests on the following matters:

ORDINANCE NO.
ORDINANCE AMENDING SECTION 16.32.060
OF THE BAKERSFIELD MUNICIPAL CODE
RELATING TO TRACT MAP IMPROVEMENTS.
BE IT ORDAINED by the Council of the City of Bakersfield as follows:
SECTION 1.
Section 16.32.060, Sub -section E of the. Bakersfield Municipal Code is
hereby amended to read as follows:
16.32.060 Tract map improvements—In subdivisions for which final tract map is
required.
E. Sewer Facilities - Payment of Fees Required.
Prior to approval of any development entitlement including, but not limited to,
any general plan land use designation amendment, rezoning, the filing of any
final map or parcel map, the granting of a conditional use permit, or after the
cancellation of a Williamson Act contract within an assessment district, the
subdivider/property owner shall pay or cause: -to be paid any fess for defraying
the actual or estimated costs of constructing planned sanitary sewer facilities for
local sanitary sewer areas pursuant to sanitary sewer plans adopted by the
council, or connection to sanitary sewer facilities therefor in accordance with
Article 5 of Chapter 4 of Division 2 of Title 7 of the California Government Code
Section 66483 et seq.
In cases where a subdivider/property owner pays greater than its proportionate
cost of sewer construction, reimbursement may occur through a reimbursement
agreement or, where an assessment district has been formed, credit against
assessments previously paid.
The following sanitary sewer areas presently exist:
1. Pierce Road -Oak Street planned sanitary sewer area;
2. Allen Road planned sewer area;
3. Brimhall Road planned sewer area;
4. Mohawk planned sewer area;
5. McDonald planned sewer area (existing residential infill sewer area);
6. McAllister Ranch planned sewer area;

7. Verdugo Lane planned sewer area;
8. Allen Road II planned sewer area;
9. Panama and Union planned sewer area;
10. Curnow planned sewer area;

SECTION 2.
This. Ordinance shall be posted in accordance with the provisions of the
Bakersfield Municipal Code and shall become effective thirty (30) days from and
after the date of its passage.
