A RESOLUTION DECLARING INTENTION TO
AMEND THE BOUNDARY FOR THE VERDUGO
LANE PLANNED SEWER AREA AND
PRELIMINARILY APPROVING THE AMENDED
FEE SCHEDULE.
WHEREAS, Chapter 16.32.060.E of Title 16 of the Bakersfield Municipal Code
and Section 66483 of the California Government Code provide for a procedure
by which the City Council may assess and collect fees for the purpose of
defraying the cost of constructing sewer facilities for local and neighborhood
sewer areas; and
WHEREAS, the City of Bakersfield desires to provide sewer facilities for a
developing area as shown on the map entitled "Verdugo Lane Planned Sewer
Area", attached hereto as Exhibit "A" and incorporated by reference; and
WHEREAS, the City of Bakersfield has constructed the sanitary sewer line as
shown on Exhibit "A"; and
WHEREAS, the City of Bakersfield desires to recoup the cost of constructing
said sewer line; and
WHEREAS, the original Verdugo Lane Planned Sewer Area was adopted
by Resolution No. 225-06 on August 30, 2006, and is currently part of Ordinance
Section 16.32.060.E of the Bakersfield Municipal Code relating to Sewer Facilities;
and
WHEREAS, current planned sewer area fees are set to expire by the end of
year 2021; and
WHEREAS, it is necessary to amend the Verdugo Lane Planned Sewer Area
fee schedule and boundary because of the annexation of two County lots that
are part of County Service Area 71 within the existing planned sewer area into
the City that will tie-in to existing City sewer system, and will not benefit from the
Verdugo sewer line; and
WHEREAS, the proposed amended Verdugo Lane Planned Sewer Area
fees set forth in Exhibit "B", attached hereto and incorporated by reference, do
not exceed the reasonable estimated cost based to provide sewer services.

NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield
as follows:
1. The foregoing recitals are true and correct and are incorporated
herein.
2. The Council hereby preliminarily approves the Amended
Verdugo Lane Planned Sewer Area boundary and fee schedule
attached hereto as Exhibit "A" and Exhibit "B" respectively, as a
replacement to the original Verdugo Lane Planned Sewer Area
fee schedule and boundary.
3. Subdivision or development of property within such area will
require payment of fees per the attached schedule.
I HEREBY CERTIFY that the foregoing Resolution was passed and adopted
by the Council of the City of Bakersfield at a regular meeting thereof held on
