May 5, 2021 Bakersfield City Council Meetings
On March 18, 2020, Governor Gavin Newsom issued Executive Order N-29-20,
which includes a waiver of Brown Act provisions requiring physical presence of
the Council or the public in light of the COVID-19 pandemic.
Based on guidance from the California Governor's Office and Department of
Public Health, as well as the County Health Officer, in order to minimize the
potential spread of the COVID-19 virus, the City of Bakersfield hereby provides
notice that as a result of the declared federal, state, and local health
emergencies, and in light of the Governor's order, the following adjustments
have been made:
1. The meeting scheduled for May 5, 2021, at 2:00 p.m. will have
limited public access.
2. The meeting scheduled for May 5, 2021, at 5:15 p.m. will have
limited public access.
3. Consistent with the Executive Order, Councilmembers may elect to
attend the meeting telephonically and to participate in the meeting to
the same extent as if they were physically present.
4. The public may participate in each meeting and address the City Council
as follows:

Mayor Goh presented Alexander Fan with the Mayor's medal in
recognition of receiving the California State Seal of Civic Engagement.

a. Proclamation to Jeremy Tobias, CEO, and James Burger, Outreach
& Advocacy Coordinator of CAPK, declaring May 2021 as
Community Action Month in Bakersfield.

Lamar Brandyskii expressed concern with the vandalism of the
Jastro Park stage; and submitted written material.
CouncUrnember Gonzales requested staff to follow-up with Mr.
Brandyskii to address his concerns.

The following individuals expressed concern with systemic issues
within the Police Department and the need for change in the
community: Josth Stenner; Patrick Jackson, President of the NAACP
Bakersfield; Nadine Escalante; Riddhi Patel; and Evelyn Torres.

Eddy Laine expressed appreciation for the support and
encouragement of the Council for the clean-up of San Miguel; and
suggested regular enforcement and patrol of the Kern River
Parkway and other City parks.
g. Jonathon Yates, Board member of the Hub of Bakersfield, spoke in
support of the allocation of Measure N funds for the revitalization of
the Old Town Kern neighborhood; and submitted pins to the City
Clerk.

and provided a PowerPoint presentation.
The following individuals expressed concern with the Police
Department and in support of a participatory budget process:
Riddhi Patel; Evelyn Torres; and Reginald Gardner.
Motion by Vice -Mayor Weir to receive and file the presentation.
Motion passed with Councilmember Parlier absent.
Mayor Goh recessed the meeting at 7:08 p.m. and reconvened the meeting at
7:18 p.m.

b. Fiscal Year 2021-22 Proposed Budget Overview.
(Staff recommends the City Council receive and file the report.)
City Clerk Drimakis announced a staff memorandum was received
regarding item 6.b., transmitting correspondence received after
the publication of the agenda.
Assistant City Manager Huot made staff comments and provided a
PowerPoint presentation.
Finance Director McKeegan made additional staff comments and
continued the PowerPoint presentation.
The following individuals expressed concern with the proposed
budget: Mandy DeSchutter; Daulton Jones; Emma De La Rosa,
Leadership Counsel for Justice and Accountability; Jessica Rios;
Jared Haug; Dipenpreet Kaur; Sofia Nuno; and Troy Hightower
(submitted written material).
Councilmember Arias requested that staff provide additional
options for money that is currently proposed for highway
beautification improvements.
Councilmember Smith requested additional attention on the Kern
River Parkway and potentially add an additional Rapid Response
Team.

aa. Purchase of three Four Door Police Interceptor Utility Vehicles:
1. Extend bid from Jim Burke Ford ($104,309.97) for the
purchase of Police Interceptor utility vehicles for the
Police Department.
2. Appropriate $123,259 Equipment Fund Balance to the
Public Works Department's Operating budget to fund
the amount of purchase costs and associated vehicle
outfitting. $63,259 of this amount was recovered through
fleet rental rates for three unbudgeted Police Interceptor
Utility Vehicles and the additional $60,000 covers costs
necessary to get the vehicle outfitted with the required
equipment for police operations.
3. Transfer and appropriate $41,051 Self -Insurance Fund
balance to the Public Works Department's Operating
budget within the Equipment Management Fund to fund the
amount of purchase costs to be paid by the Self -Insurance
Fund for the three unbudgeted vehicles.
Miscellaneous:
ab. Authorize the Finance Director to write off accounts receivable
in various funds totaling $11,004.10 and forward non bankrupt
accounts to a collection agency for additional collection efforts.

software license(s), accepting licensing terms that contain
indemnification and arbitration clauses.

b. Public Hearing to consider adoption of resolution concerning an
appeal by Montbattan Homeowners regarding Planning
Commission's approval of Tentative Tract Map 7383 to subdivide
26.08 acres into 24 single-family residential lots (ranging in size from
10,001 square feet to 17,999 square feet), one sump lot, and one
remainder lot (developed with a church), in a E (Estate) and E -CH
(Estate - Church) zone located at the northwest corner of Reina
Road and Old Farm Road. An Addendum to the Mitigated
Negative Declaration will also be considered.
(Staff recommends upholding the decision of the Planning Commission, and
adopting resolution denying the appeal.)

a. Housing Element Annual Progress Report for Calendar Year 2020.

Development Services Director Boyle made staff comments and
provided a PowerPoint presentation.
Motion by Vice -Mayor Weir to receive and file the report. Motion
passed with Councilmember Parlier absent.
b. Bakersfield Southern Pacific Station.
(Staff recommendations Council direction.)
City Manager Clegg made staff comments and provided a
PowerPoint presentation.
Motion by Councilmember Gonzales to authorize the City Manager
to negotiate a 12 -month lease with Union Pacific and return to
Council with budget options for the necessary improvements and
agreements to maintain the property. Motion passed with
Councilmember Parlier absent.
14. COUNCIL AND MAYOR STATEMENTS
Councilmember Weir requested staff provide additional information on
what the money allocated for San Miguel Grove will specifically do and
any additional recommendations beyond the upcoming projects that
would be needed to bring the area to standard and maintain it.
Mayor Goh expressed appreciation to staff for the recent Council
Chamber upgrades.
Mayor Goh advised an event will be held on Thursday, at 10:00 a.m. to
unveil a new memorial garden at Greenlawn Southwest Funeral Homes,
remembering loved ones lost to COVID-19.
Mayor Goh advised a gathering will be held on Thursday, at 12:00 p.m., at
the Liberty Bell, in honor of the National Day of Prayer.
