HomeMy WebLinkAboutORD NO 3200ORDINANCE NO. 3200 NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING SECTION 17.06.020 OF CHAPTER 17.06 (ZONING MAP) OF THE MUNICIPAiL CODE OF THE CITY OF BAKERSFIELD REGARDING PREZONING OF PROPERTY KNOWN AS THE ALLEN NO. 1 ANNEXATION (WARD 4). WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the ,City of Bakersfield, the Planning Commission held a public hearing on a request by the City of Bakersfield to zone certain property now being annexed to said City and made several general and specific findings of fact which warranted a negative declaration of environmental impact; and WHEREAS, by Resolution No. 55-88 on December 15, 1988, the Planning Commission recommended approval and adoption of an ordinance amending Title 17 of the Municipal Code to approve an A-20A (Agricultural Twenty-Acre Minimum Lot Size) and R-S (Residential Suburban), or more restrictive zone, as delineated on attached map, by this Council and this Council has fully consid- ered the findings made by the Planning Commission as set forth in that Resolution; and WHEREAS, there appears to be no substantial detrimental environmental impact which could result from this zoning action; and WHEREAS, the proposed zoning substantially conforms to the General Plan; and WHEREAS, the City Council has determined after due con- sideration of the motion and recommendation of the Planning Commission, herein on file, together with the reasons advanced at the Planning Commission hearing, that said zoning should be authorized upon annexation of said property to the City. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: SECTION 1. A. All the foregoing recitals are found to be true and correct. B. The Negative Declaration for this zoning action is hereby approved and adopted. C. That Section 17.06.020 of Chapter 17.06 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by extending the boundaries of said map to include that certain property in the County of Kern located at at the northeast corner of Stockdale Highway and Allen Road, con- tiguous to the boundary of the City of Bakersfield known as the ALLEN NO. 1 ANNEXATION, upon the annexation of said property to the City of Bakersfield, the boundaries of which property are shown on the map hereto attached and made a part of this ordinance, and are more specifically described as follows: TO AN A-20A (AGRICULTURAL TWENTY-ACRE MINIMUM LOT SIZE) ZONE: A parcel of land consisting of portions of Sections 25 and 36, Township 29 South, Range 26 East, and Section 31, Township 29 South, Range 27 East, M.D.B.& M., in the unincorporated area of Kern County, California, more partic- ularly described as follows: Beginning at the Southwest corner of said Section 36, being at the intersec- tion of Allen Road and Stockdale Highway; THENCE North along the West line of said Section 36 (and Allen Road center line), a distance of 5279.40 feet to the Southwest corner of said Section 25; THENCE continuing North along the West line of said Section 25 (and Allen Road center line), a distance of 1328.00 feet to the Northwest corner of Lot 25 as shown on "Sales Map of Lands of J. B. Haggin," filed August 20, 1890 in the Office of the Kern County Recorder; THENCE East along the North lines of Lots 25 through 31 of said J. B. Haggin Sales Map, a distance of 4586.96 feet to the Northeast corner of said Lot 31, also being the Northwest corner of Lot 32 of said Sales Map, (also being the Northwest corner of Lot 32 of said Sales Map and the Northwest corner of Parcel Map No. 4244 filed in Parcel Map Book 19, Page 130 in the Office of the Kern County Recorder); - 2 - THENCE South along the West line of said Lot 32, a distance of 1320.92 feet to the Southwest corner of said Lot 32 (and said Parcel Map No. 4244); THENCE East along the South line of said Lot 32, a distance of 660 feet to the Southeast corner thereof, also being the Northwest corner of said Section 31 and the point of intersection of the Jewetta Avenue and Brimhall Road center lines; THENCE East along the North line of said Section 31, a distance of 3377.25 feet (more or less) to the Northwest corner of Lot 3 as shown on "Sales Map of Lands of Kern County Land Company," filed April 20, 1891 in the Office of the Kern County Recorder; THENCE South along the West line of said Lot 1, a distance of 1320 feet to the Southwest corner thereof; THENCE East along the South line of said Lot 1, a distance of 1940 feet to a point on the West line of the East 40 feet of said Section 31; THENCE South along said West line, a distance of 1527.67 feet to a point on the Southerly right of way line of the Cross-Valley Canal; THENCE Southwesterly along various courses of said canal right of way line, to a point on the West line of said Section 31 lying 150 feet (more or less) North of the Southwest corner of said section; THENCE Southwesterly, in a direct line, 270 feet (more or less) to a point on the South line of said Section 36 lying 225.70 feet West of the Southeast corner of said section; - 3 - THENCE West along the South line of said Section 36, a distance of 5053.15 feet (more or less) to the point of beginning. EXCEPTING THEREFROM all rights of way for public roads and the Cross-Valley Canal. Containing 1,193.77 net acres (more or less). TO AN R-S (RESIDENTIAL SUBURBAN) ZONE: Three parcels of land consisting of por- tions of Sections 25, Township 29 South, Range 26 East, and Sections 30 and 31, Township 29 South, Range 27 East, M.D.B.& M., in the unincorporated area of Kern County, California, more partic- ularly described as follows: Parcel 1 Commencing at the Southeast corner of said Section 25, being at the intersec- tion of Brimhall Road and Jewetta Avenue; THENCE North along the east line of said Section 25 (and Jewetta Avenue center line), a distance of 1320 feet to the Southeast corner of Lot 17 as shown on "Sales Map of Lands of J. B. Haggin," filed August 20, 1890 in the Office of the Kern County Recorder and the True Point of Beginning; THENCE West along the south lines of Lots 17 and 18 of said J. B. Haggin Sales Map, a distance of 1320 feet to the Southwest corner of said Lot 18; THENCE North along the West line of said Lot 18 (also being the West line of Tract No. 4908 filed in Map Book 36, Page 63 in the Office of the Kern County Recorder), a distance of 1320 feet to the Northwest corner of said Lot 18 (and Northwest corner of said Tract No. 4908); THENCE East along the North lines of Lots 17 and 18 of said J. B. Haggin Sales Map, also being the center line of Palm Avenue, a distance of 1320 feet to the Northeast corner of said Lot 17 (and Northeast corner of said Tract 4908); THENCE South along the East line of said Lot 17, also being the center line of Jewetta Avenue, a distance of 1320 feet to the Southeast corner of said Lot 17 and True Point of Beginning; EXCEPTING THEREFROM all right-of-way for public roads. Containing 32.68 acres (net). Parcel 2 Beginning at the Southwest corner of said Section 30 also being the point of intersection of the Jewetta Avenue and Brimhall Road center lines; THENCE North along the West line of said Section 30, a distance of 329.86 feet to the Northwest corner of the South 1/2 of the South 1/2 of the Southwest 1/4 of the Southwest 1/4 of said Section; THENCE East along the North line of said fractional section segment, a distance of 1309.52 feet to a point on the West line of the Southeast 1/4 of the Southwest 1/4 of said Section 30; THENCE North along said West line, a distance of 447.05 feet to the Northwest property corner of that land deeded to Michael A. DePetro; THENCE North 87~13'26" East along the North property line of said land to a point on the West line of the East 1/2 of the Southeast 1/4 of the Southwest 1/4 of said Section 30; THENCE South along said West line, a distance of 807.30 feet to a point on the South line of said Section 30, also being on the center line of Brimhall Road; THENCE West along said south Section line, a distance of 1984.00 feet to the True Point of Beginning; EXCEPTING THEREFROM all right-of-way for public roads. Containing 19.00 acres (net). Parcel 3 Beginning at a point on the North line of said Section 31 lying 660 feet west of the Northeast corner of said section. Also being a point on the center line of Brimhall Road and the Northeast corner of Lot 2 as shown on "Sales Map of Lands of Kern County Land Company", filed April 20, 1891 in the Office of the Kern County Recorder; THENCE South along the East line of said Lot 2, a distance of 1320 feet to the Southeast corner of said lot; THENCE West along the South lines of Lots 2 and 3 of said sales map, a dis- tance of 1320 feet to the Southwest cor- ner of said Lot 3; THENCE North along the West line of said lot, a distance of 1320 feet to the Northwest corner thereof, also being a point on the North line of said Section 31; THENCE East along the North lines of said Lots 2 and 3, and Brimhall Road center line, a distance of 1320 feet to the Point of Beginning. EXCEPTING THEREFROM all right-of-way for public roads. Containing 39.09 acres (net). SECTION 2.
