RESOLUTION NO. 1 Q 0 2'
A RESOLUTION ADOPTING INCREASES TO
WATER RATES FOR CITY DOMESTIC WATER
SERVICE AREA.
WHEREAS, Chapter 14.04 of the Bakersfield Municipal Code authorizes the
City Council to establish rates and fees sufficient for the City to recover the costs
of providing domestic water services; and
WHEREAS, City staff prepared and mailed a notice of public hearing to
residential and commercial users on May 11, 2021 as required by Proposition 218
notifying them of the proposed rate increases (Cal. Constitution Article XIID,
section 6); and
WHEREAS, a public hearing was held on June 2, 2021 in order to receive
evidence and hear all persons interested in or objecting to the proposed rate
increases; and
WHEREAS, the adoption, of water rate increases is exempt from the
California Environmental Quality Act (CEQA) under the California Public
Resources Code Section 21080(b) (8); and
WHEREAS the City Council has considered the staff report, rate study, public
comments, and information presented at the public hearing, and written protests;
and
WHEREAS, the rates and charges set forth in Exhibit "A," attached hereto
and incorporated by reference herein, do not exceed the reasonable estimated
cost of providing the services for which the fees are charged.
NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Bakersfield
as follows:
1. The above recitals and findings are true and correct and are
incorporated herein by reference.
2. The Council finds that insufficient written protests were presented to
prevent the proposed rate increases.
3. The Council ratifies the Proposition 218 process followed by the City.
4. The Council adopts the fees established in Exhibit "A," and shall
become effective according to the following schedule:
a. 4.0% increase will be effective July 1, 2021;

5. The adoption of these fees and charges complies with Proposition
218.
6. This Resolution is effective July 1, 2021.

CITY OF BAKERSFIELD NOTICE OF PUBLIC HEARING
ON PROPOSED INCREASE TO DOMESTIC WATER RATES
NOTICE IS HEREBY GIVEN that a public hearing, accepting testimony, will be held before the
Bakersfield City Council at 5:15 p.m., or as soon thereafter as the matter may be heard, on
Wednesday, June 2, 2021 in the Council Chambers of City Hall located at 1501 Truxtun Avenue,
Bakersfield, California, for the purpose of considering increases to Domestic Water Rates. The
new rates, if adopted, will go into effect on July 1, 2021. In compliance with Proposition 218,
affected property owners within the City of Bakersfield's Domestic Water Service area are
hereby informed of the proposed increase to Domestic Water Rates.
Background
Pursuant to Chapters 14.04, 14.06 and 14.08 of Title 14 of the Bakersfield Municipal Code,
the City of Bakersfield Domestic Water System provides residents and customers a firm,
reliable, high quality water supply in quantities and under sufficient pressure to meet customer
demands. Charges for water service are paid directly by property owners and/or occupants
through bills rendered monthly. In compliance with Proposition 218, property owners and/or
customers of the City of Bakersfield Domestic Water System are hereby informed of a proposed
increase in the Domestic Water Rates. Your water service is included in this action and is
identified in the accompanying bill enclosed in this mailing.
All rates reflect a proposed 4% increase. The proposed increase will help meet the costs of
operation and maintenance, meeting water quality standards, and funding for capital costs. A
table of proposed changes is on the second page of this document.

If you have questions regarding this notice or how it may affect your property, call
(661) 326-3715 Monday through Friday from 8:00 a.m. to 5:00 p.m. or email staff at
water@ bakersfieldcity.us. Supporting documentation is available for review at the City Clerk's
Office, City Hall, 1600 Truxtun Avenue, Bakersfield, California 93301.
PUBLIC COMMENT will be accepted in writing on or before the hearing date indicated above
at the City Clerk's Office. Any interested person, including property owners , may appear
and be heard to protest against the increase to the Domestic Water Rates. Protests to the
proposed increases must be delivered in writing to the City Clerk, City of Bakersfield,
Truxtun Avenue, Bakersfield, California 93301, prior to the conclusion of the public hea&g or��
June 2, 2021.

All written protests must 1) identify the assessor's parcel number, 2) identify the address of the
parcel, and 3) include the name and signature of the property owner submitting the protest. If
written protests are received from a majority of owners of the affected parcels, the proposed
rate increases will not be approved.
