AMENDMENT NO. 1 TO RESOLUTION NO.
157-2020 CHANGING TERMS ALLOWING
FINANCE DIRECTOR TO DISPENSE WITH
BIDDING TO PURCHASE PARTS AND
SERVICES REQUIRED TO REPAIR AND
UPGRADE THE DEWATERING PLC AT
WASTEWATER TREATMENT PLANT NO. 3, NOT
TO EXCEED $175,000.
WHEREAS, on August 16, 2020 City experienced critical failure of programmable
logic controller (PLC) #7 serving the solids dewatering operation at Wastewater
Treatment Plant No. 3 (WWTP 3); and
WHEREAS, on October 21, 2020, the City council adopted Resolution No.
157-2020 allowing the Finance Director to dispense with bidding procedures to
purchase parts and services needed to repair and upgrade PLC #7, not to
exceed $100,000; and
WHEREAS, Schneider Electric, the manufacturer of the affected hardware
and software recommended Cannon Corporation to perform the required work;
and
WHEREAS, Cannon Corporation (Cannon) is the sole Schneider Electric
Registered Alliance Partner in the City's geographical area; and
WHEREAS, after the initial scope of work was completed it was determined
that the new PLC hardware was unable to communicate with the existing PLC
hardware in the centrifuges; and
WHEREAS, WWTP 3 is in need of completing the repairs and upgrading PLC
#7 in order to ensure the reliability of the solids dewatering operation; and
WHEREAS, the additional parts and services requested from Cannon
increases the not -to -exceed limit from $100,000 to $175,000, in accordance with
Exhibit A; and
WHEREAS, the Public Works Directors recommends the Council to amend
Resolution No. 157-2020 and authorize the Finance Director to dispense with
bidding in accordance with subsection D.2 of Section 3.20.060 of the Bakersfield
Municipal Code.

NOW, THEREFORE, IT IS HEREBY RESOLVED AND ORDERED by the Council of the
City of Bakersfield as follows:
1. The above recitals are true and correct.
2. Resolution No. 157-2020 is hereby amended to read as follows:
3. The expenditure of funds for required parts and services shall
not exceed One Hundred Seventy -Five Thousand Dollars
($175,000) .
3. Except as amended herein, all other provisions of Resolution No.
157-2020 shall remain in full force and effect.

ADDITIONAL SERVICES AGREEMENT

Description of Additional Services and/or Materials:
Due to complications with PLC -7 upgrade and Modbus Plus communication to the Centrifuge
PLCs, the team (comprised of City and Cannon staff) determined that upgrading the Quantum
PLCs in Centrifuge 2, 3, and 4 would be the most expedient route to upgrade the entire solids
control system.
Scope of the added work includes the following:
- Labor to move Centrifuge 1 PLC components (M340) to Centrifuge 3, due to failed VFD
for Centrifuge 1. Subsequently, new PLC components will be reinstalled in Centrifuge 1.
- Labor to install Centrifuge 2, 3, 4 PLC hardware, network components, and update panel
power and signal wiring as required.
- Labor to upgrade the Centrifuge 2, 3, 4 PLC program, based on the Centrifuge 1 code.
- Labor to test and validate the Centrifuge operation and solids control system, including
PLC -to -PLC communication and PLC-to-SCADA communication.
- Materials for Centrifuge 2, 3, 4 PLC hardware, panel components and wiring as required
to upgrade the panel.
- Expenses for on-site work, including travel expenses.
Proposed Fee: $ 73,130.00
Authorization:
In witness whereof, the parties hereto have caused this agreement consisting of the Request for
Additional Services, and the original signed proposal letter and Appendix A dated November
2011 and any other necessary and applicable documents to be executed and effective as of the
date and year first above written. Payment is due within 15 days of completion of work.
Any additions and/or corrections to this agreement will be addressed in a separate agreement.
