A RESOLUTION AUTHORIZING SUBMISSION OF THE CITY OF BAKERSFIELD'S
APPLICATION FOR THE COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM -
CORONAVIRUS 2020 HOMEKEY SET-ASIDE FUNDING AND AUTHORIZING THE
CITY MANAGER OR DESIGNEE TO EXECUTE A GRANT AGREEMENT AND ANY
AMENDMENTS THERETO FROM THE 2020 COMMUNITY DEVELOPMENT BLOCK
GRANT PROGRAM - CORONAVIRUS RESPONSE (CDBG-CV) AND/OR THE
2020-2021 FUNDING YEAR OF THE STATE CDBG PROGRAM WITH THE STATE OF
CALIFORNIA TO RECEIVE FUNDING.
WHEREAS, the Congress of the United States has enacted Title I of the Housing and
Community Development Act of 1974, and amendments (the "Act"). The Act provides
for Community Development Block Grants for eligible activities; and
WHEREAS, CITY has submitted required documents to the Department of Housing
and Urban Development ("HUD") for receipt of a Community Development Block Grant
("CDBG") pursuant to the Act; and
WHEREAS, California Government Code Section 53703 authorizes cities to
participate in federally funded health, welfare, public works, and community -
improvement programs, and empowers cities to contract with public and private
agencies; and
WHEREAS, international, national, state, and local health and governmental
authorities are responding to an outbreak of respiratory disease caused by a novel
coronavirus named "SARS-CoV-2," and the disease it causes has been named
"coronavirus disease 2019" ("COVID-19"); and
WHEREAS, on March 27, 2020 the Federal Coronavirus Aid, Relief, and Economic
Security ("CARES") Act was passed in response to COVID-19; and
WHEREAS, the US Congress has authorized the US Department of Housing and
Urban Development (HUD) to provide supplemental Community Development Block
Grants ("CDBG-CV") through the CARES Act; and
WHEREAS, the State of California,
Development ("HCD") issued a Notice of
2021, for funding under the CARES Act; and
Department of Housing and Community
Funding Availability (NOFA) dated April 21,
WHEREAS, pursuant to the State's FY 2019-2020 Annual Action Plan Second
Substantial Amendment, HCD has set aside approximately $50 million of its CDBG-CV2
funds to support eligible projects that applied for funding under the Homekey NOFA,
located in non -entitlement or entitlement jurisdictions; and

WHEREAS, these funds are available to California units of local government for
projects applied for under the Homekey NOFA that are CDBG-CV2 eligible; and
WHEREAS, Milestone ("Project") is the acquisition and multi -phase
rehabilitation/modernization of motel located at 1622 Union Avenue Bakersfield,
California to provide homes for people experiencing or at risk of homelessness; and
WHEREAS, the Housing Authority of the County of Kern ("HACK" herein) successfully
applied and received funding for phase I of Project under the Homekey NOFA; and
WHEREAS, the City of Bakersfield is a CDBG entitlement City and eligible applicant
under the Homekey NOFA; and
WHEREAS, HACK and the City of Bakersfield desires to submit a project application
to support Phase II of Project.
NOW, THEREFORE, The City Council of the City of Bakersfield Resolves as follows:
1. The above recitals are true and correct and incorporated by reference herein.
2. City of Bakersfield has reviewed and hereby approves the submission to the State
of California of one or more application(s) in the aggregate amount of, not to
exceed, $4,400,000 for (i) the following CDBG-CV activities, pursuant to the CDBG
Method of Distribution as described in the State of California 2019-2020 Annual
Action Plan August 2020 Second Substantial Amendment, and/or (ii) the following
CDBG activities, pursuant to the CDBG Method of Distribution as described in the
State of California 2020-2021 Annual Action Plan January 2021 Substantial
Amendment:
Rehabilitation of Motel to Permanent Supportive Housing$ 4,400,000.00
3. The City of Bakersfield hereby approves the use of Program Income in an
amount not to exceed $0 for the CDBG-CV activities and/or CDBG activities
described in Section 2.
4. The City of Bakersfield acknowledges compliance with all state and federal
public participation requirements in the development of its application(s).
5. The City of Bakersfield hereby authorizes and directs the City Manager, or designee,
to execute and deliver all applications and act on the City of Bakersfield's behalf in
all matters pertaining to all such applications.
6. If an application is approved, the City manager or designee, is authorized to enter
into, execute and deliver the grant agreement (i.e., Standard Agreement) and

any and all subsequent amendments thereto with the State ofCalifornia for the
purposes of the grant.
7. If an application is approved, the City Manager or designee, is authorized to sign
and submit Funds Requests and all required reporting forms and other
documentation, without limitation, including any covenant or regulatory
agreement as may be required by the State of California from time to time in
connection with the grant.
