A RESOLUTION OF THE CITY OF BAKERSFIELD ADOPTING A
POLICY REGARDING THE CITY COUNCIL VACANCY
APPOINTMENT PROCESS (COUNCIL POLICY 8.1)
WHEREAS, Charter Section 16, requires the City Council to fill a vacancy on
the Council by appointment if said vacancy occurs less than six months prior to
the date of the next general election; and,
WHEREAS, there are state laws which set forth provisions on Council
vacancies.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Bakersfield as follows:
1. The above recitals are true and correct and incorporated herein by
reference.
2. City Council shall decide how and when to fill Council vacancies
based on the facts and circumstances surrounding each situation, and in
accordance with the Charter and applicable laws.
3. This Resolution shall become effective and in full force upon final
passage.

by the Council of the City of Bakersfield at a regular meeting thereof held on
